We still don’t know what caused 30 year old Webster resident David Njuguna to drive into State Trooper Thomas Clardy’s stationary vehicle on the Mass Pike in Charlton, killing the veteran law enforcement officer. We would like to believe that drugs and alcohol or distracted driving weren’t the cause, but there’s just too much on his Facebook page that suggests otherwise. He likes to drink:

He was admittedly overtired on the day of the accident:
In the past he has admitted that his lack of sleep has affected his driving:
But by far the most shocking post we saw was this one:
Like I said, we have no idea what caused this accident, but this guy has had his license suspended before for refusing to take a breathalyzer. He clearly drives too fast, drives distracted, likes to booze, and isn’t afraid of unspecified drugs. I’m not sure how they will go about proving what caused this accident and we will reserve casting judgement for now, but all the signs point to an out of control driver who had no business being on the road. We watched the news last night and saw Trooper Clardy’s family mourning. We also saw an interview with Njuguna’s sister in law and she was clearly remorseful and saddened by this all too. It’s just a terrible situation all around, but one that definitely looks like it was avoidable.

When a person steps foot in the drivers seat it comes with a lot of responsibilities.. this guy clearly wasn’t being a responsible careful driver. The investigators could get a search warrant for his cell phone. And if it can be proven that he was texting or facebooking while driving he could face vehicular homicide charges. Also a search warrant for his blood alcohol level since Hipaa Privacy Rules would prevent anyone in the medical field to volunteer that information. I understand he was hospitalized so they do have blood samples immediately following the incident.
If you rule these two things out then the criminal process may not be applied in this case other than a civil infraction for speeding if accident reconstruction investigators can determine that.

Nissans have electronic limiters that stop them from reaching that speed, but any garage with tuning software can turn that shit off, allowing a stock Nissan to reach that speed, all though it would take a while to get it up that high. Intake and exhaust mods would make it easier to do so of course
