In one of the most insane stories we’ve had come our way in a while, there’s a guy from outside Binghamton, NY who was killed by a cop in 2014, moments after he shot and killed another cop. And now the family of the idiot who killed the cop is suing the police department for killing their son:
Source: The family of a man killed by a Johnson City Police officer after shooting and killing another officer is suing Binghamton and Johnson City, alleging that officers didn’t follow police protocol when they responded to the incident and purposefully suppressed information after the fact. The lawsuit — filed on behalf of Jon and Cherrie Clark, the parents of James Clark, the man who was killed — comes three years after the bizarre and tragic incident played out in the parking lot of Southern Tier Imaging in Johnson City, leaving investigators and the community puzzling over what, exactly, happened to Clark on the morning of March 31, 2014.
According to the lawsuit, which also lists then Binghamton and Johnson City Police Chief Joseph Zikuski and two unnamed Johnson City police officers as defendants, responding officers failed to follow protocol when they didn’t immediately contain Clark at the scene. Clark “should have been contained at the scene and before he had an opportunity to run for Officer Smith’s car,” the lawsuit states. That allegation, along with at least one other in the suit, starkly contrasts with details laid out in police reports.
According to a 203-page collection of incident reports obtained by the Press & Sun in 2014 through freedom of information requests, Clark arrived at work around 7 a.m., speaking about magnets and terrorists. He called the police and told dispatchers that if someone brought a bomb into the country and attached it to one of the MRI magnets, people would die. When Johnson City Police Officer David Smith arrived at the scene, Clark ran toward him, punched him in the face, took his gun and fired two shots to his head, killing him. A second officer, Louis Coici, shot and killed Clark, but not before Clark climbed on his back, attempting to grab his weapon, according to reports.
According to two witnesses interviewed by the police, Smith was either still in his car or had just gotten out of his car when Clark punched him and began wrestling him. “I saw the man practically inside the cop car driver’s door — on top of the cop,” said a witness interviewed in a deposition. The lawsuit also alleges police officers prevented first responders from treating Clark before they handcuffed him, even though Clark was “laying on cold wet snow in the street and unable to offer resistance and otherwise totally harmless.”
But according to the police reports, Clark continued to struggle while Johnson City Police Officer Louis Cioci, a security guard and a civilian attempted to handcuff him. “(Clark) was still fighting, eyes open and ranting the entire time,” states a Johnson City Police report. Before he was handcuffed, Clark jumped onto Cioci’s back, and tried to reach for his gun, police records state. Clark also inserted his finger into the trigger guard of Cioci’s gun, leading it to fire into a neighboring church parking lot, reports state.
This is a case so absurd that even Richard N. Vulva would take a pass. Weird that this guy was killed by a police officer and I never heard of him before. Wonder why….
Oh yea, he’s white. No one gives a shit. I mean, I’m white, and I could honestly care less that he’s dead. He’s a criminal and a cop killer. And even if he didn’t kill a cop, lethal force was still more than justified. Isn’t if funny how that works? Just because you share a skin pigmentation with a person who was killed by the police, doesn’t mean that the police were inherently wrong for using lethal force to take down that very dangerous person. Just because a white guy was killed after putting himself in a very dangerous and lethal situation, doesn’t mean that Turtleboy is gonna take the streets with “white lives matter” signs, even though the vast majority of people killed by the police are in fact white.
Anyway, anyone can file a lawsuit in court. We’ve been sued for $153,000, but it was laughed out of court by a judge. God willing, this will be too.
