A different kind of story here at Turtleboy Sports today. A woman who is battling stage 4 lung cancer posted on Facebook and alleged that she was turned away at a wellness spa called Tu Moda Spa for Beauty and Wellness which is located on Pleasant Street in Worcester. Why would a wellness spa turn this woman down? Here’s what the customer alleges…

We have to be careful with stories like this. Last year an online mob came after Paul Conzo Salon and Spa after some ratchet wanted them to do something to her hair that would have permanently damaged it. The woman was a recovering addict and claimed that she was turned away because her hair was too wild and “ethnic.” She also said that she was not offered a refund on her gift certificate. When her story was posted on Facebook a million people shared it and started to smear Paul Conzo Salon:

Well, as it later turned out, the woman WAS offered a refund since Paul Conzo was unable to provide the service that she requested. It just wasn’t the refund she was hoping for:

“We gave the woman $200 the amount the boyfriend paid for the gift certificate. We were having a promo at the time Pay $100 get a certificate for $110. Pay $200 get a certificate for $220. She was given exactly what he paid. Should I have made her sign something saying she got it? In hindsight probably, but we never would have thought like that.”

So her boyfriend paid $200, and the woman was offered $200 in return. She didn’t understand that if the store gave her back $220 they would be losing $20. The lesson that was learned from this is that online mobs who destroy local businesses should probably get their facts straight before doing so.

But this is a very different situation. Unlike Paul Conzo, Tu Moda is not denying this happened. We reached out to both sides for comment. The woman who made the post was very polite with us but did not want to go on record. Tu Moda has not returned our request for comment, but the offer still stands going forward. Paul Conzo gladly took our phone call and couldn’t wait for the opportunity to explain in their own words what really happened. Clearly this woman is telling the truth and has nothing to gain by lying.

Where do we even begin? There are so many things wrong with what this woman experienced. This is a spa that advertises for beauty and wellness and it has been used by Nurse Practitioners in the past for previous patients. A place that offers massage for wellness should not rely on outdated medical advice that carries absolutely no evidence to support their claim that a massage would spread her cancer.

Any place that believes a massage, especially a gentle massage, will spread cancer is a place that should not operate under the guise that they are capable of providing wellness services. She is battling stage 4 lung cancer and wanted a gentle massage, which is called a “light, tender touch” massage in the therapy world. Massage during chemotherapy is thought to promote pain, stress, and anxiety relief. The old belief that massage can spread cancer comes from the theory of deep tissue massage, but that has been thoroughly refuted. This woman was not asking for a deep tissue massage. In fact, she received a massage at Tu Moda 3 months ago and they performed the same services without causing a scene.

Their bluff was called when they asked her to provide proof that it was safe for her to have this massage, and even though that was done, they still didn’t provide the services. Irrefutable proof that she had sent Tu Moda medical clearance is seen below as her Nurse Practitioner left a negative (and well deserved) review on Tu Moda’s Facebook page:

We find it hard to believe that a nurse practitioner would lie and risk her license with a posting like this. The story is clearly true.

The worst part is that they verbally blasted her medical information in front of other employees and guests at the Spa. That in in and of itself is enough reason to never return to this spa again. When you read the woman’s initial complaint of Tu Moda, her description and how they treated her is so grossly inappropriate. They spoke to her like she was some type of alien with an unknown disease. This is cancer. It sucks. I think almost every single one of us can say we know someone personally affected by cancer. So why the “no way I’m not touching her” response? This is the same sort of ignorance that occurred during the AIDS epidemic. They should have never treated her this way. If they did not want to provide services, they should have spoken to her in a private room, and offered her a complete refund so she can obtain those services elsewhere.

But unlike the Paul Conzo story, these complaints are 100% grounded in facts.

 

The last thing a person who is battling cancer needs is to be treated this way. Not only is cancer physically painful, it is emotionally and spiritually as well. People who struggle with cancer are already fighting a battle with their mind and body. When they have a chance to get a day of relaxation provided to them by a caring friend and Nurse Practitioner, they should be able to spend that day thinking of nothing……absolutely nothing. They should feel free, and their mind should be clear. Instead, this poor woman was sent away upset, feeling angry, disappointed, disrespected, and hurt.

What we’re asking for demanding is a public apology from Tu Moda, to this woman, Karrie Nason. We are not in the business of intentionally harming local businesses. We honestly believe that the masseuse who refused her treatment did so out of pure ignorance, and didn’t maliciously try to hurt anyone. So this is a learning moment for them. The masseuse is not necessarily a bad person, she honestly might know any better. But she can’t go on operating like this. That is not OK. Thus why we are trying to teach her. However, if she continues to act like this isn’t a big deal, and she continues to live in ignorance, then we won’t call off the online mob that is already berating them with one star reviews.

Additionally, the way that management at Tu Moda is handling this is unacceptable. They should be BEGGING this woman to come back. One of their employees screwed up. It happens. But when that happens it is incumbent upon management to make it right. “John” the manager promised this woman that his manager would call her back after she complained. That never happened. They also haven’t returned our calls. She called them back and they made it clear to her that they were not interested and were sick of dealing with her. They want her to go away. Sorry, that ain’t happening.

This woman was nothing more than a number to them. She’s also probably extremely tired because she has cancer, and doesn’t have the energy to fight this. So we will fight it for her. Cancer runs rampant in my family, as it does for countless others. We take this one personally. This woman was DEHUMANIZED, and I can only imagine the pain she was going through when she was publicly humiliated like this. It’s hard enough living with this deadly disease, not knowing what the future holds. But to be treated like this by some ignorant masseuse, and then have that person’s bosses take no actions against them is simply unacceptable.

Compassion is so simple and should be a prerequisite when running a business like a Spa who claims to be about wellness. Not only should they offer a full refund, they MUST issue a public apology to this woman on their Facebook page.

    “HIPAA. It’s Not Just for Doctors Anymore

    Who Does HIPAA Affect?
    The Department of Health and Human Services can only enforce HIPAA-related penalties against “covered entities” as they are defined by the regulations. The regulations define covered entities as healthcare providers, health plans and healthcare clearinghouses who engage in any number of electronic transactions. A healthcare provider under HIPAA is a person or company that furnishes, bills or is paid for health care. This definition is fairly broad and encompasses not only hospitals and physicians, but also includes chiropractors, dentists, optometrists, hospitals, schools, nonprofit organizations that provide some healthcare services, and even government agencies. However, the true scope of parties that are affected by HIPAA does not end there.

    Business Associates. What Am I Required to Do?
    HIPAA only directly regulates covered entities. However, the regulation does manage to exert great power over business associates as well. Any disclosure of protected information made by a covered entity to a business associate without a business associate agreement in place violates the HIPAA Privacy Rule. Through the ability to prosecute covered entities for disclosures that are not made subject to a business associate agreement, the HIPAA Privacy Rule exerts pressure on both parties to enter into a business associate agreement. Without an agreement in place, the covered entity cannot make the necessary disclosures that the business associate requires to provide the contracted services. The only decision left to the business associate is to agree to all of the HIPAA-required contractual provisions or terminate the business relationship. It is not surprising, given these choices, that most business associates are choosing to subject themselves to the HIPAA requirements.

    To the woman going through this foolishness, I’m usually anti-sue, but I’d see a lawyer. You’ve been through enough bullshit physically and emotionally. I wish you the best and hope you find some peace with this. No one deserves to be humiliated like this.

    To the “esthetician with TRAINING” — get fucked. Go tweeze some eyebrows.

    WHOA!! Lets hear from some other MASSAGE people and Massage Schools. I taught for ten years in a massage school a while back and AT THAT TIME that was common knowledge that you SHOULD NEVER do massage on a person with cancer as i might help it to spread it thru their body.
    COULD SOMEONE who is in the position to make an educated comment on this please reply to this posting?? Massage school or massage therapists?

      You taught in massage school 10 years ago? “common knowledge that you SHOULD NEVER do massage on a person with cancer as i might help it to spread it thru their body.”

      “However, the circulation of lymph – from massage or other movement – does not cause cancer to spread. Researchers have shown that cancer develops and spreads because of changes to a cell’s DNA (genetic mutations) and other processes in the body.”

      Guess who I believe? (psssst – it’s the latter)

      “Massage school or massage therapists?”

      Nah – I’ll stick to doctors and nurses – the truly educated ones.

    These people are thieves.

    I had to cancel a Monday morning appointment due to freezing rain making my driveway a sheet of glare ice. They charged me $267 cancellation fee even though it was a weather-related incident. In all the years I’ve been doing business with salons, dentists, doctors, and other professionals, I’ve never been ripped off so badly by anyone.

    No offer to reschedule, rebook, or try to fix anything.

    Looks like all of the horrible reviews are right on the money.

      FYI.

      I just received a phone call from Tu Moda management in response to my letter.

      They refunded the entire no-show fee, and apologized profusely for the charge. They also addressed all of the concerns that I included in my letter, and were incredibly sincere, polite, and honest.

      I’m MTF transgender, and was concerned about the quality of service that I was going to receive. They related that they had dealt with trans clients before, and welcomed their business. They indicated that they were professional, and would have no issues with anyone who showed different gender presentations.

      They did the right thing, and addressed the issue.

    Are the massage areas sound proof? Elephant in the room?

    I saw and shared your post on Facebook AND the following is a copy of my own Facebook comments:

    This place should be boycotted! However, some perspective nobody has mentioned: I watched my mother die of lung cancer. I was living with her and in my 20s! And I loved my mom very much! This particular cancer causes the patient to cough incessantly and spit too. It is very stressful and forgive my bluntness, gross to witness. I feel deep empathy for the torture the person dealing with these symptoms must feel. Makes me cry actually. But to this day It stresses me out intensely if I am in the vicinity of someone with uncontrolled coughing. I will even leave a movie theater or restaurant mid-meal it disturbs me so much.

    I imagine at a place that is supposed to be serene for other patrons and staff having one patron’s medical issue disturb everyone else might be an issue. What to do? Massage is a great relief especially for someone with medical issues, but how many patron’s might want a refund because THEIR services were disturbed by another patron? Are these massage areas sound proof?

    This establishment never made mention of such an issue AND they humiliated the poor woman and used utter nonsense junk science as a defense and made her jump thru hoops that when she did what they requested they still denied her services and were rude? THAT is horrible, and boycott, even lawsuit worthy!

    I really wonder if they did this to her because of the disruption her symptoms could cause or ignorance, or spite. It sucks ass but I just had to be the voice to the uncomfortable elephant in the room. It sucks for everyone.. and honestly stirs me and makes me miss my mom and feel awful my mom had to endure such torture before she died. Its okay to admit being witness to someone’s suffering is also a kind of suffering! Its okay to want to avoid being around suffering people! It doesnt make one a bad person. For me it just means I care and it hurts me too much to witness. I get massage therapy for my medical conditions and if I could hear someone coughing incessantly I wouldn’t be able to relax enough to receive the benefits of my massage or physical therapy.

    So this news about this spa makes me wonder. Can a business deny services if someones symptoms are disruptive to others? And did this Spa try to avoid the uncomfortable truth and instead make things so much worse? I wonder….

    As an esthetician with TRAINING, they did not mean she spread her cancer around the building, they mean that because she has had lymph nodes removed (handy fucking waste filters) they need a TRAINED ONCOLOGY MASSAGE therapist to do her treatment so they don’t hit the wrong spot in her body and SPREAD HER CANCER TO PLACES IT WASN’T BEFORE.

    Fucking idiots. I’d have turned her down too. I would not want to be responsible for that.

      I got kissed about the damn Facebook post by the woman turned down and just commented and assumed it would be the same bullshit I come across on this blog all the time. Stage 4, ya gonna die. I’m sorry but it’s happening, give her the massage. But, you can absolutely spread cancer cells in to parts of the body it was not before by massaging lymph nodes and releasing those toxins. It is not outdated; it is still very true.

      At the school I went to, they still offer oncology massage training to avoid mishaps. We can’t even use high frequency machines or massage certain parts of the face and neck of cancer patients. After the initial consultation, if we feel that the treatment is unsafe for the client, we can absolutely refuse treatment. Usually we skip the parts of the massage and high frequency in those areas, but sometimes it is better to be safe than sorry. It sounds like the esthetician was doing her job and following her training. If it was outdated information, esthetics and massage schools would have discontinued their training in that area.

      Also, a nurse practitioner is not an esthetician and we are not medical professionals. I will use what I learned in school to keep people happy and healthy, and I am taking no chances.

    I just received a call from Jose, the owner of Tumoda. He personally apologized for what happened. We discussed all of my frustrations. He said that the well being of their client is most important and thats why they had asked for a doctors note. I told him that I felt it was wrong to deny clients services b/c of Cancer and suggested he research the matter and educate his staff. Also, he should educate his staff on being more compassionate/understanding to their clients. Jose offered to meet with me and offered to make things up to me , and he really sounded heartfelt. I do not want anything more from Tumoda than what I got from Jose today. The opportunity for him to hear ME. He assured me that I would receive a check for my gift card tomorrow. I have received countless satisfying services from Tumoda over the years, but just need a fresh start. I truly hope that my words were heard and that my experience will never be repeated again.

      Unfortunately It takes one bad experience to outweigh all the good. To everyone who owns a business or thinking about opening one. You better hope the customer/client is always right.         A good business man owns up to his mistake publicly. He doesn’t hide behind a faux screen name to further berate a customer.

        You’re lucky Tu Moda has had this amount of success. I’m guessing it’s because you haven’t dealt with someone smart enough to let the world know about the irresponsible and disrespectful way your employees treat clients.

    I used to go to Tumoda….largely because a friend did my fills and pedi’s. When I first started going there, almost 15 years ago, it was a great place. Recently it has gone downhill. Focussed to much on beauty products and hair, it seems. I have found a new place that is wonderful. My friend is not at Tumoda anymore. Because I got acrylic fills, I always felt like a second class citizen there. And I told the owner so. If this story is true, I won’t be going there ever again. I’ll find somewhere else for massages.

    In my non-professional experience just personal, Nurse Practitioners have nearly the same authority of a Physician. NP’s can prescribe medications, give medical advice like a Dr., and provide medical referrals upon either request by the patient or in their own opinion. From my experience and limited knowledge the Physician in charge of your case has to always sign off on what a NP’s suggestions and recommendations are. That’s from just me with my experience as a patient. That’s it.

    It’s not everyday you read an article from a blog or from anywhere else for that matter that slightly gets you teary eyed. I say slightly because, ya know, I’m a guy and that ain’t supposed to happen.

    Seriously though point is – I’m on total board with Karrie Nason’s plight. And by far this IS one of the most heartfelt and BEST stories I have read in here in a very very long time. This IS the TBS that I knew. Nice job Fiesty – you slammed this out of Fenway, opps I mean Yankee Stadium…. Keep it up and best of luck.

      You are completely correct but I just want to clarify that a NP doesn’t need to get the Dr. to sign off. She is fully licensed and has authority to do all you stated and is a primary care provider but she works under the MD’s license so the MD is ultimately responsible.
      They work independently in the office. It’s not like she gives diagnosis and meds then needs to search out a Dr for a signature is all I’m trying to make sure everyone understands.

      I have never even laid eyes on my listed PCP. The NP or the PA are my providers. 🙂

    Personally I never would never have told them I had cancer in the first place, its none of their business.
    I also don’t feel it is right for the reviewers who have never been there to review them based on a story someone else told

        Apparently the Doctor’s note is a very common requirement in these situations. This was pretty easy to find. So if this was true then it sounded like the Spa was following prudent practice.

          Did you even read the article? She provided everything she needed by the individual who is overlooking her care. They still refuse her services based off of an aluminium hat outdated theory that massages spread cancer. Research has proven otherwise.

          I really just can’t with people like you. Always attempting to find the false in everything even when the information is right at your fingertips.

            Publius, I wrote the article. Did you also read where her NP left a review stating the facts as well? So, she’s willing to risk her career? Can you give me some good reasons as to why she would be willing to risk her career as a Nurse Practitioner to falsify a story like this?

      Gotta agree. Just because the spa didn’t return a call to TB doesn’t mean anything. And I find it hard to believe anyone would deny a paying customer a massage because it might “spread their cancer”.

        If I’m wrong I will take the beating as I’m the one who wrote the article. Mirror Mirror, I highly doubt this story is fake. We would have to assume that an NP would be willing to lie and ruin her credibility and career at her current job.

        What would be her reasoning for lying publicly on Facebook? What does she get out of lying or making up a story by sticking up for her patient?

        That’s my major question to you or anyone second guessing the validity of this woman’s statement.

        What can the nurse practitioner get out of it?

    I lost both of my parents to cancer. Having to watch them go through this was very hard. We had hospice coming in to help and twice a month they would have a massage therapist come in. Those visits were something they looked forward too and never once did I hear anything about not being able to provide a massage because it would cause the cancer to spread. And even if there was a shred of truth to that myth, when you’re at end stage cancer further spreading is the least of your concern…you’re just trying to get that last little bit of happiness out of life before it’s over. That place sucks and I hope there is some legal recourse for that woman and her family to get justice from this.

    HIPPA only applies in the healthcare industry realm, of which this “spa” is likely not considered a part, however, common decency dictates that one shouldn’t act like an asshat and blast someone’s personal info for all to hear.       No one is claiming that. It’s palliative care – if you don’t know what that is, look it up. And they have no right to refuse it, if for no other reason than it was already paid for. It’s also illegal to discuss someone’s medical information in a public setting – they’re idiots, and I won’t be going back there ever.

      She wasn’t looking to be HEALED. It massages healed cancer there would be a lot less suffering in the world. Read a book and learn something. She went there for a massage. A relaxing massage. Tu Moda denied her services thinking (ignorantly) that to touch her would spread her cancer. Stupid is as stupid does (and thinks.) What’s infuriating is that they discussed her condition within earshot of everyone.

      These people are complete idiots. My mom had stage four lung cancer. Her massage therapist came to her house weekly, sometimes a few times a week, free of charge, to massage her and it was one of the only things she looked forward to. I massaged my mom myself because I could see how much she enjoyed it. How could these people refuse this poor woman. I hope this shithole shuts down!
