Charlie Baker Signs Off On Cops Detaining Drivers Who “Look” High And Force Them To Prove Their Innocence Because He’s Still Butthurt About Legalized Weed

Not to get political, but this is bullshit….

At a news conference Thursday, Governor Charlie Baker and public safety officials addressed issues surrounding the legal consumption of marijuana. The group introduced the ‘if you feel different, you drive different’ campaign which aims to educate cannabis users about the dangers of driving impaired. The campaign is part of the governor’s road safety initiative that includes hands-free driving, and lower speed limits in construction zones.

“But, there is still more we can do here in Massachusetts to continue to make our roads safer,” Baker said.

Through the new campaign, police officers are selected for special training to help them detect impaired driving. Those officers are called Drug Recognition Experts or DRE’s. If a police officer pulls someone over and believes they are under the influence of drugs they must take that person back to the station where a DRE will administer a fluid test to see which drug they are on and how much is in their system.

If someone refuses that test, they could lose their drivers license. Law enforcement officials said they are optimistic about the possibility of a roadside fluid test in the near future.

This might sound good on paper, because who wouldn’t want to get stoned drivers off the road? But don’t be fooled – this is just a way for the government to detain you unlawfully. “He looked high” is gonna the new justification for taking law abiding citizens into custody and forcing them to pee into a cup in order to prove they’re NOT violating the law.

So if you’re tired because your crotch fruit was screaming all night and you’ve got bags under your eyes on your way to work, be prepared to be dragged to your local police station where the burden of proof is on you to prove you’re not guilty, instead of the other way around.

But it’s OK because according to Karyn Polito it’s “common sense” that your freedom and liberties are taken from you. This whole thing is just butthurt blowback because Charlie Baker can’t get over the fact that Massachusetts voters legalized weed. He is such a massive toolbag. Imagine he was this proactive about investigating how Leigha Genduso became a state trooper? Ya know, the DRUG DEALER the state police investigated and then hired anyway despite doing a background check. It seems to me that trusting the state police should be a higher priority than keeping potheads off the road. Just sayin.

P.S. Marijuana stays in your system for close to 2 weeks. What happens if you legally purchased and smoked weed a week ago and your piss test comes back with THC in it?

Nothing with Charlie Baker is legit. He has asked a security company to put disgraced Environmental Police Colonel and Charlie’s former driver to work. He has no shame. Maybe it is so McGinn won’t release any of the skeltons in his closet

People drive like shit period. Add a smartphone or booze or pills or weed into the mix and it always gets worse. Stand next to any intersection in any city surrounding Boston and it doesn’t take long to smell all the marijuana being smoked by passing cars. It isn’t a problem until they kill someone in your family. Then it’s a big deal

Baker’s comments and this headline are the TL:DR synopsis of the whole story. In real life what happens is an officer on scene does the same SFSTs as usual to a suspected impaired driver. If after that they have probable cause to arrest them they do. The clues and the thresholds for PC are the same. The SFSTs roadside are the same whether its alcohol, heroin, weed, anything, hence the STANDARDIZED Field Sobriety Tests. After they are arrested if they submit to a PBT roadside or the breathalyzer later and it comes back 0.00 or some other number under .08 inconsistent with how impaired they appeared THEN you call in a DRE, who does a far more in depth evaluation. The evaluation can be refused (don’t know why people agree to do it honestly). One great thing about the DRE evaluation is it shows if the drugs are psychoactive, meaning currently effecting someone. If you smoked weed two weeks ago you may have it in your system still, but you would not show the signs of impairment. Trust me, DRE evaluations are the farthest thing from guilty until proven innocent. This headline is more misleading than Elizabeth Warren’s Texas Bar Association application.

Guilty until proven innocent, illegal search and seizure based on a DRE opinion. The state of Massachusetts has already admitted the THC “tests” are highly inaccurate. So if you refuse said inaccurate test, your license is pulled. Screw the F-up state of Massachusetts and Charlie Baker is a total POS.

If this happens to Michael Bennett (who I think is a tool) and they find nothing, I hope he’d sue their asses off. Las Vegas was a lie, but this shit is “I don’t like the cut of his jib”.

He’s the kind of guy that would push it just to get stopped so he can screw with the cops. And, in this situation I’d be on his side.

I tried one joint in my life 30 years ago. Felt dumber than I normally feel. Not for me.

I’ve got no issues with people using. About the only way this would work if there was video evidence of a car not being in control in the first place.

Texting while driving is far more dangerous and prevalent than people who are stoned. Why don’t you figure out how to stop people from playing on their phones, updating social media going 70 mph drifting all over the road or randomly hitting the brakes because someone liked their post? Distracted driving is 6X’s more likely to end in a crash than drunk/stoned driving. Why ignore the obvious and focus on the inconsequential? Baker is hot trash and his Lt is just as bad.

    • hank
      March 15, 2019 at 12:33 pm

Also, if someone looks stoned and can be detained and put through “tests” can the same assumptions and actions be used if someone looks like a menace who’s ready to cause harm to the public, like say…..a gangbanger? Stop and frisk was a great tool to help LEO get illegal guns off the streets and keep people safe. But since it worked too well it had to be done away with.

      Hop in the cop car.
      Leave your car.
      Maybe your car gets towed.
Go to where ever to be “tested”.
      Found you are clean.
      And????
      How much time was taken?
Who gets reimbursed for the time?
      Did you miss a flight?
Did you miss a doctors appointment?

The cops don’t care, they are on the job getting paid while you may not be.

Do the cops drive you back to the car?
If towed do you have to pay to set the car free?

Who is bringing me to pick it up? Who is paying for the flight I just missed? Lots of law suits in the near future.

  • White Power Ranger
    March 15, 2019 at 11:52 am

Theres no actual reliable data to suggest “stoned driving” is a problem. The numbers in Colorado are such that, a population increase that isn’t cited in the numbers easily explains the slight uptick in driving accidents. It’s a very shoddy, hack piece of work that is done by the federal government to ensure that weed can still be used to create criminal cases that lead to incarceration to fuel the for profit private prison industry.
I’m no Marxist, but it’s time to face the fact there in reality are terrible rich old men who’s sociopathic mental disposition allows them to believe that an authoritarian approach to lifestyle choices ( see freedom of expression) is okay because it lines their pockets. This is simply a non issue that is being propped up to protect an industrial complex that needs criminals to make profit. Unfortunately, not all US law is just, and all it takes is the legal prohibition of things to make a criminal. Quite simply, make something illegal and punishable by law, and you create criminals and crime where it doesn’t really exist.

    • Hugh-Bo Mont
      March 15, 2019 at 12:09 pm

Mass govt doesn’t care about the prison-industrial complex. They go out of their way to keep criminals out of jail. More things are to be had in the racism-industrial complex, namely votes for the Ds.

      • White Power Ranger
        March 15, 2019 at 1:55 pm

Hugh Bo Mont, and this is with respect and no malice.
        A. I understand the difference between Federal and State government
        B. I understand we are a liberal state that goes out of their way to be such.
However, I shouldn’t of said “federal government” I should of say private prison lobbyists that work with federal govt insiders.
It benefits them greatly to take a liberal state such as Massachusetts, and do some backroom lobbying to with our state govt, to ensure that even though we are trailblazers for the legal cannabis industry, we still have a push back approach and create problems where they don’t exist. They lobby the governor to push this legislation, and they’ll then go to lobby our state govt legislative branch. If they can cite data, using “wacky liberal Massachusetts” to “prove” that cannabis legalization is poor idea, then they can use that argument to stop any Federal govt push for legalizing it, and do the same in states that may follow the decriminalization/medical/recreational model.
And to quell both federal and state govt from normalizing legal weed consumption, then yes, they can keep one more common possession charge on the books.
So, no, our state doesn’t directly benefit from for profit incarceration, but by being a catalyst for change it can really fuck things up for prison profiteers in states where it does.
It’s a game of thrones style market speculation/political stunt/Public relations move.

TB your Facts are wrong on this one. A police officer still needs PC to make a stop. If once on that stop the officer believes the driver is impaired by (by Marijuana, alcohol, narcotics, or any drug) he will administer standardized field sobriety tests. If you pass the FSTs, the. There is no sign of impairment and no arrest. If you fail FST’s then its because you are driving inspired. You are taken to the station where a highly trained DRE will conduct another series of tests to determine what the category of drug is that us causing impairment.

Have you ever driven high or seen someone driving high? They go like 4 mph! Yeah, that’s a fucking traffic hazard, but so is the goddamn potholes the size of the fucking big dig I have no choice but to hit every fucking day on the Mass Pike.

And oh yes, let’s force people to prove their innocence! Jesus fucking Christ riding a goddamn rainbow colored unicorn I pray to god this gets slapped down. Sadly, that’s almost certainly not going to happen. The kangaroo court system in this fucking state guarantees that the SJC will vote early and often to make sure this stays in place, and sadly I have almost as little faith in the United States Supreme Court. They give almost as few fucks as Baker.

  • Maggie the Cat
    March 15, 2019 at 10:27 am

Sorry, TB, I disagree. Driving high can be just as bad as driving drunk, If Charlie’s really “butthurt”, that’s because the automobile insurance companies don’t want to pay for accidents involving or caused by high drivers, on top of paying for accidents caused by drunk drivers. It’s okay with me if you personally want to pay for those accidents, but since I’ve never had an accident just leave me out of it. (Oh, by the way, some years ago my house was hit by a truck being driven by my neighbor’s kid who, the cops said, was “high as a kite”.) In fact, they said the parents were high at the time as well! The damage was minimal, but as long as that family lived across the street I worried about our house getting hit, and I no longer allowed my kids to play in the front yard. Ultimately that family’s house got foreclosed on, which made the entire neighborhood feel safer. So there is a good reason, at least to me, to seek out and stop people who are driving high.

    • Rationalize this
      March 15, 2019 at 11:42 am

I don’t care if someone smokes weed. But the state should have rolled out some kind of actual field sobriety test before recreational weed was implemented. But because the pro pot lobby and the state (who just wants their cut) were in a rush, this is the unintended consequence.

    • hank
      March 15, 2019 at 12:40 pm

But those same insurance companies had no problem when that stupid fucking law went into effect a few years ago that said if it’s sprinkling out and your headlights aren’t on, even if it’s in the middle of the day and bright enough, you can get ticked, fined and points added to your insurance $$$$. When the money is flowing in, no problem, but when the money you’ve been paying flows out it suddenly is.
