Dear Turtle Riders,

First off let me introduce myself, I’m your average Worcester born and raised twenty something girl, working to pay off her college loans and planning her upcoming wedding. As a bride-to-be, the moment I most look forward to (besides saying “I, do.” to the man of my dreams.), is having my Daddy walk me down the aisle. And let me tell you, my father is a remarkable man. On paper he is a 10 year U.S. Army Sergeant Veteran, a respected public safety officer who has served the Commonwealth of Massachusetts for the last 25 years as a court officer for the Worcester court house, correctional officer for the Worcester Sheriff’s Dept, and a prison sergeant for the Massachusetts Department of Corrections with an immaculate career and personal record. But most importantly, a man who back in 1994 at 23 years old decided to raise me, his 3 year old daughter as a single father. The kind of man who would do my hair every morning, attend every recital, and play with barbies. A caring, sensitive, very passive man who always knew to leave the job at home.

In 2000, my father got remarried and bought a home with his then new wife, where they had 2 children together. The marriage didn’t work out and was amicably dissolved in 2007. My father retained the home, paid his child support, and continued life as a devoted father and public servant.

A little while after the divorce he began seeing a woman with 5 children of her own from 3 different fathers. She had no job, couldn’t speak English, and was known to be a head case but despite warnings from friends and family, including myself, who lived with him, he continued seeing her.

He asked her and her 5 children to move into his home, expense free. He didn’t charge her rent or utilities. He let her drive his car while he was at work. He put clothes on the children’s back, attended their teacher/parent meetings, in short did all the things he would do for his own children.

The move-in was a bit rough at first, she and the children had been used to living in Worcester Housing and the Main South Community. My father passed it off as misunderstanding due to the language and class barrier but then the woman’s true colors started coming out.

At first it was just emotional abuse. Yelling and screaming at him when she didn’t like something. Then it grew to name calling, degradation, and slapping. My father dealt with it, better than be alone, and it’s not like it happened all the time.

The slapping soon turned to punching and biting and if he tried to push her off, she would grab the nearest thing. A leather dog leash to the back or a ceramic vase over the head. She would play emotional mind games, threaten to cry wolf and say she was the victim, move and hide his guns on him, have her kids make up lies on her behalf.

I would try to call the police but my father would plead with me not too. He was so in fear that she would retaliate in some form. I moved out after a couple years of being in the home, I couldn’t take watching my father get treated in such a manner.

The abuse continued on and off. I continually asked why wouldn’t he leave her and he continued in the fear that she would make him lose his job and he hoped she would just leave on her own accord. He had been politely asking her to move out, he even offered help.

Late last year he even tried to help her get back into Worcester Housing but she was denied at a hearing due to an eviction from the Worcester Housing Authority for stabbing one of the fathers of her children on housing property.

The abuse was getting worse. Police were called to the home several times by my father and when asked if he would like to press charges against her, he would decline because he was so in fear in what she was capable of. He avoided spending time at his own home as much as possible. He would rather work overtime at the prison or spend time with his children at his former wife’s home.

He eventually started to see his former wife romantically again.  Though his relationship with the abusive woman had been over, he was too scared to let her know of his new relationship. In early February 2015, the woman found out about my father’s rekindled relationship with the mother of his children and punched him in the back of his head. He called the police but again refused to press charges.

At the urging of his former wife, he wrote a letter to his supervisor and notified the DOC of the abuse he was going through. He was referred to a domestic abuse advocate through the DOC to find out his options and was set up with an appointment for Feb 18.

On February 17, after spending the night at his former wife’s, my father went to his home to collect some clothing. The house seemed normal, the woman and her children were hanging around the house. The woman asked my father for some money so he left to the bank and came back to the home and gave her some cash. She left with her oldest son to run errands.

So he collected clothes and decided to remove his two licensed and secured guns from the house after the prior weeks’ incident. Before doing so he opened the cases they were secured in. One of the weapons was missing. My father immediately called the woman 3 times and finally got in touch with her.

He knew she had to have taken it and asked her where it was. She said she’d be right there. She arrived and he asked her where the weapon qa and she admitted she had it. He told her he wanted her out of the home when she got her settlement money (a few months prior, my father and the woman were hit by a drunk driver. My father was hoping the woman would use the settlement money from the accident to move out)

She asked to stay in the house until summer. He said no and told her to retrieve his gun or he would call the police. She agreed and went to the basement followed by her oldest son. Deciding to wait for the weapon outdoors, he took his clothing and other secured weapon to his vehicle in the driveway, locked the clothes and weapon in the trunk of the car and waited for her in the driveway. The next thing he knew this is happening:

Police ran up the street, asked him if he was Jaime Fuentes. He said yes. When police asked if he had a weapon, he said yes and told them one was locked inside his vehicle secured and gave the officer his car keys. He was arrested and put in the back of a squad car.

The officers went into the home to check on the alleged victim Nelly Rivera. What you won’t hear the Telegram reports is that they never brought her to a hospital, she didn’t have a scratch on her, the bedroom where the altercation supposedly took place was in perfect condition, and none of the children knew what was going on except for the older son who she had make the phone call. That is Ms.Rivera’s daughter’s Facebook page. If you scroll down to her posts on February 17 you will see her live Facebooking pictures of Mr. Fuentes’ arrest with the status “feeling confused” as well as comments with smiley faces like it was a funny moment.

You also wont see in the Telegram that after exiting the home, officers were about to pull away. Jaime Fuentes had to tell them Ms.Rivera had taken his second weapon. The police had assumed the secured weapon in the vehicle was the one used in the alleged assault. Ms. Rivera turned over the stolen second weapon only after being asked by the officers for it. She gave it to the officers still in the holster with the magazine removed.

How do you wrestle a gun away from someone and have time to put in back in the holster and then remove the magazine since you claim the weapon was loaded and you don’t know how to use a gun? She also told police she didn’t know how she wrestled the weapon away from a weapon trained veteran and prison sergeant. She also had said during the altercation Mr. Fuentes had accused her of cheating when it was known by all it was Mr. Fuentes had gotten back with his ex-wife.



Mr.Fuentes was denied bail and put into a county jail for 5 days pending a dangerous hearing, you can find the results of that hearing here

During the course of the hearing there were dozens of supporters for Jaime Fuentes. Friends, family, coworkers, and neighbors who all testified on his behalf. Witnesses who had seen her strike him, strike her children, heard her yells. Witnesses who had known of her taking his weapons before and testified to his fear of her.

His ex-wife brought in evidence of harrassing voicemails Nelly had left on both her and Jaime’s phone. Rivera denied it was her voice on both voicemails. The judge had to stop Nelly from incriminating herself during the hearing when asked about the fact she was currently committing welfare fraud (in the five years she lived with Jaime Fuentes rent free she had been claiming a different address to receive welfare benefits), had cases with Department of Children and Families, and had a violent history with prior boyfriends.

The judge released Mr.Fuentes on his own personal recognizance with the stipulation that he stay away from Ms.Rivera pending trial. She was given two weeks to leave his home. He was allowed to go to his home a week later to collect personal belongings with a police escort. Upon arrival he noticed his television was missing, his clothing was gone down to underwear, and important paperwork missing. His car, that had been there since his arrest, wouldn’t start. A month later, she is still in his home with all five of her children and he continues to foot the bills for the mortgage and utilities even though he isn’t allowed anywhere his home. He has been suspended from his job pending the outcome of the charges.

The story has been picked up by the associated press and was even mentioned on Nancy Grace as well as stories in the Boston Herald and Boston Globe.

With a pretrial hearing scheduled on April 14, he wont even step foot in the city of Worcester without a companion for fear of bumping into Ms.Rivera and having her accuse him of something. He is constantly under public scrutiny. Domestic Violence is a huge hot button issue right now. Everywhere you look the media is pushing to punish the perpetrators of this awful crime.

Awesome, I am all about standing up for the victims. What I won’t stand for is a presumption that you’re guilty before proven innocent in a court of law because the court of public opinion assumes you are guilty.

Around a week ago, the Worcester Telegram & Gazette published an article regarding a bill that is aimed to make it public the moment someone is arrested for domestic violence, even go so far as to allow bail to be delayed for first time offenders. The Telegram used my father’s case as a primary example and focus. Failing to mention the fact that my father insists he was the victim and during his hearing had dozens of supporters and witnesses testifying to his character and the accuser’s violent past.

My father has been scrutinized, suspended from his 25 year career, and pumped with so much fear, he can not even sleep at night. All of this happening before we even go to trial.

This is a warning to everyone. Just because you read something in the main stream media, doesn’t make it 100% true. Even though it’s the popular opinion, having a badge doesn’t automatically make you a bad person. And yes, the accused perpetrator can actually be the victim. My Dad’s innocence will be proven but I refuse to stand for his name to be dragged through the mud in the process. I believe in justice not slander.

These legislators are not going to use my dad as a poster child to push a ridiculous bill to get their names out there, just because domestic violence and bashing law enforcement are the cool issues to get behind right now. Any person, male or female, can make a domestic abuse claim falsely without facing any consequences, while the falsely accused have their lives destroyed.

Men can most definitely be domestic abuse victims too and the double standard needs to stop. Just because someone works in law enforcement does not make them a bad person. We need to stop making examples out of people that do not need to be made an example of. We need to protect the real victims.

I write this as that 3 year old little girl defending the man she knows her Daddy truly is. Thank you for your attention Turtleboy Readers.

    There are ALWAYS two sides to every story. My husband is dealing with a mentally unstable ex, whom he shares a child with, and I believe every single word of your story. There are a lot of great people with good intentions, being helped by the system. But there’s a dark side to the system…These women who have child after child to get more and more money from welfare. And if they have a special needs child its a blessing, because wow! now they can collect SSI too. This hateful woman your father met had a taste of the good life, and she was not going back to Main South, by any means necessary. She is a text book manipulator and abuser and deserves jail for what she did. I am so sorry for what you and your family are going through, but look at it this way, all her crazy is out now!! She showed who she really is, and hopefully the law can work on your side now

    I am sorry that your family is going through this. Your love for your dad is admirable and we must all learn how to understand that there are always two sides of the story, and we should not judge without all the facts.

    However, the not judging that you are asking for your father also goes hand in hand with stereotyping. Which you used when describing your father’s girlfriend. The fact that she has kids by different fathers and didn’t speak English, are irrelevant. Yet you used these facts so that the readers could understand what a “despicable” person she is.

    Yes, that’s right… I am a woman that has kids by multiple fathers and whose native tongue is not English, yet the woman you describe here, has nothing in common with me. Im not about to explain myself, I could care less about what “society” deems appropriate as far as bearing children by one or ten different men. The language barrier however reaches into racism, that’s an entirely different beast, that shouldn’t even be visited by someone with a last name like yours.

    Conclusion: if you’re asking for the benefit of the doubt for your Dad, you shouldn’t be condemning an entire sector of women, for the actions of one.

    I was in the court room the day he had been charged. But was in awe at the fact that the lady who claimed the abuse was in the hall way earlier laughing and heard saying ” look afraid “to her children , who looked so confused as why she was doing this. I don’t know the whole story nor was I there but all the body language & behavior this lady had showed me she was a whack job . All she cared about was staying at the house , stating she had no where to live & that he pay the bills & something about a car? I felt horrible for the man as you can see how degraded he felt. God will pull you guys through this. The way I look at it is you are a strong family, it shows from this amazing letter you wrote . Prayers for you all.

    He was at a court trail aprox 2 yrs ago for a street fight ..putting his children n wify in danger ..n tryd getting Matt n Jason case in trouble.. They won the court trail..proving he was the instigator

    My neighbor reported his exgirlfriend for abuse many times. He had tried to get her out of his house. To no avail, she shot and killed him in 2011. Domestic violence goes both ways. My neighbor did not deserve what happened to him.

    As a fellow CO and victim of an attempt to file a false allegation for a restraining order against me I feel for Officer Fuentes if this is true. I hope the truth comes out and if Officer Fuentes is innocent I pray the courts do what is right and put her in jail. In my case the judge saw through the allegations against me and dismissed the request for the temporary order

      If I didn’t know better, I would think your post was written by my nephew. About six years ago, his wife(at the time) thought up a plan for her, their two kids, her best friend and her 3 kids, to al live together in my nephews house by concocting an abuse charge against him, and dreaming of the child support she would get. His mother, my sister, a very smart attorney, smelling a rat, grabbed him went directly to the courthouse, and came out with a restraining order in hand and full custody of the kids to my nephew. SHE was out of the house, and paying him child support to boot!

    She has been abusing me senselessly for years. I’m not allowed to do anything. She still kicks me out of the home, rips my clothes up with scissors, throws them outside all the time. I couldn’t begin to tell you what I’ve been through.

    Thank you for sharing your side of this story. The day it came out and I read it, I looked at my husband and said, ” This guy is innocent “. Something just didn’t add up. Anyone that knows me will tell you, I am into punishing anyone Male/Female for DV. Men don’t report it like women do. It’s something that I think makes them feel less than a man. I feel they are more of a man, because they won’t hit bad, but look for help. I really hope this works out for your dad. This female ( can’t say women), who sounds like a piece of crap, many children by many men, most likely getting money from us working people’s paycheck needs to be punished. Her poor children. This is not how a child should learn about life. I hope the daughters have a better sense on how to treat people. God Bless you and your family. I hope for the best.

    As a woman I know that too many other women are more vicious than any man would understand. I know a lot of women who are, well, b****s. They may tell a man they love him and they may appear to love him, but they always and forever only think of themselves. They only get pregnant and have children to hold onto a guy, not because they love the guy and want to have children for the right reasons. Any woman with kids by three different men is one of that type, as in “three strikes and you’re out”.

    It also bothers me that “the system” always assumes the woman is the victim. If nothing else that’s “gender bias” (using a liberal phrase), and it shows how stupid the liberal legal system is. Men can be victims as well, and to think men cannot be victims is to be willfully blind. Like predators, some women have a talent for picking out the guys they can manipulate and use for their own purposes — a home, money, children (who can be used to get child support once the guy figures out he’s been had). It’s not that particular guy they want, but what that guy can give them. I have seen this behavior a number of times

    Just because men are mostly physically stronger than women doesn’t make them the aggressors. In nature it is often said “the female is deadlier than the male.” People are part of nature, and that rule holds for them, too.

    Maybe he is innocent, but it Sounds like he needs to secure his firearms. Did all these kids have the same access to his guns as the wife? If they were secured properly she wouldn’t have gotten to them.

    Thanks for sharing another side of this Haydee. Your dad is lucky to have you in his corner. The media loves to portray a “war on women” whenever they can, so the idea of a male domestic violence victim is beyond their capability to comprehend. Little do they know or want to admit some women can be as crazy and violent as men. Maybe the Telegram & Gazette should not use the case of a person not convicted and still presumed to be innocent as a primary example and focus to bolster their story.

The idea that if someone says they are a victim of domestic violence and the man gets arrested without a shred of evidence or a second on actually investigating is not fair and equitable amongst the different genders.
