Framingham Bum Says His 38th Arrest By Cops Is Unjustified Despite Having Rape, Assault Charges Pending

Metrowest Daily NewsSince 1992, Sean Pelfrey of Framingham has been arrested at least 37 times by Framingham Police. On Monday, police arrested Pelfrey, 38, for the 38th time, charging him with two separate assaults on Sunday. Pelfrey has also been arrested nine times in Natick since 2004. At Pelfrey’s Framingham District Court arraignment on Tuesday, prosecutor Daniel Storms asked Judge Jennifer Stark to hold Pelfrey without bail pending a hearing to determine if he is a danger to the public.

On Sunday, around 7 a.m., Pelfrey attacked a man he knew in front of the Salvation Army in downtown Framingham, the prosecutor said. Pelfrey hit the man in the knee with what appeared to be a pipe, Storms said.“(The alleged victim) was able to grab the pipe and put Mr. Pelfrey in a headlock,” said Storms. “The defendant pulled out a knife and said ‘I’m going to cut you.’” The man let Pelfrey go and called police. Pelfrey rode away from the scene before police arrived and police obtained a warrant for his arrest.

That night, around 9:30 p.m., a man and a woman arrived home on Waverly Court. There, they saw Pelfrey standing on the street. According to a police report, they recognized Pelfrey from being featured in the MetroWest Daily News because of numerous past arrests.“ They got out of the car and Mr. Pelfrey charged at them with a knife,” Storms said. When the woman went into her home, she saw Pelfrey in her backyard. He was waving a knife and yelled at her. When she told him she had called police, he fled.

Police searched for him without success. The next morning, the woman went to her car and discovered three of her tires had been slashed, Storms said.Police found Pelfrey on Union Street on Monday at 5:54 p.m. and arrested him. Police charged Pelfrey with two counts of assault and battery with a dangerous weapon for the first incident, and then charged him with assault with a dangerous weapon, intimidation of a witness and malicious destruction of property worth more than $250 for the second incident.

Along with asking for Pelfrey, of 3 Merchant Road, to be held without bail until a dangerousness hearing, Storms asked Stark to revoke Pelfrey’s bail on several open cases. They include a charge of rape from a December arrest in Framingham, and an assault and battery with a dangerous weapon and civil rights violation case from last Thursday.“ We did make a motion to revoke last week, but Judge (Martine) Carroll released him without bail. Since then he has picked up two new cases.”

Pelfrey’s lawyer, Bridget Bradley, argued against revoking bail. She said the alleged victim “lacks credibility.” Stark ordered Pelfrey held without bail pending a dangerousness hearing on Thursday. She said the motion to revoke bail will be decided that day. Pelfrey was angry he was held.

“Those people lied,” he told the judge. “These people tried to run me over. I did not brandish a knife. I just don’t know how I’m being held for something I didn’t do.”

Gotta love that headline: “Man says his 38th arrest by Framingham police is unjustified.”

It was all a big misunderstanding. Just like the other 37 arrests. Good thing we live in a state where psychopaths who go up to random people, chase them with knives, and then slash their tires, are promptly sent back out onto the streets. The guy clearly looks like he’s learned his lesson. Definitely.

On December 28, 2015, he was arrested for beating up his homeless girlfriend. According to the MWDN, after the alleged assault, the woman said Pelfrey took her cellphone and threw her shoes onto a roof so she couldn’t walk to the police station to file the complaint. The woman was in her stocking feet when she arrived at the police station, Storms said.

Man, what a boob. He looked like he was in rare form when he was arrested back in October 0f 2015:

He’s clinging onto that one remaining tooth for dear life. Never surrender!!

The girlfriend claimed that he raped her, but he was not charged with that crime on December 28. And despite the fact that he was already out on bail in THREE other cases, the judge still decided to release him with no bail:

Storms asked Judge Douglas Stoddart to hold Pelfrey on $500 bail and to revoke his bail on three open cases, including one in which he is charged with punching the same woman in the face and another where he stood on top of a parking garage and told pedestrians he would shoot them. Pelfrey denied all of the allegations.

“She slapped me to wake me up because she was cold, and I went to get something and I came back with a carpet and the carpet wasn’t good enough for her,” said Pelfrey. “I did take one of her shoes and threw it in the air and it unfortunately landed on a roof. I never took her phone. I never stole anything. I don’t know what this rape allegation is all about.”

Stoddart said he wasn’t sure what to do with the case.

“You’re the most frequent visitor we have in this court room, and she (the victim) is probably the fourth most,” he said.

Talk about a high maintenance homeless chick. What, this discarded carpet isn’t good enough for you your majesty? Looks like I’m gonna have to arbitrarily throw one of your shoes in the air for no particular reason. But yea, it was a complete accident that it landed on the roof. Because stuff like that happens all the time.

Alright, so obviously these two idiots are frequent fliers. If they wanna get high and throw each other’s shoes onto the roofs all day then go for it. But once he starts standing on buildings and telling normal people that he’s gonna shoot them, that’s where you have to draw the line. And this guy was accused of RAPING her. It’s kind of messed up that the judge didn’t seem to care about that, because the very next day he was arrested AGAIN for rape. But the judge released him anyway because:

“Her credibility of the alleged victim is now and always is an issue because of the frequency she appears in court,” said Stoddart. “I don’t think I’d be persuaded by a police officer who testifies that she said that or she said this.”

Oh good. We’re releasing dangerous homeless rapists back into society because the judge doesn’t believe his crackhead girlfriend. What could possibly go wrong?

That right there is the face of a man who knows he can pretty much do anything he wants. That right there is the face of a rapist who is delighted as hell to live in a state where he will never, ever be held accountable for his crimes. God bless the Commonwealth of Massachusetts. Can’t say I blame him for once again blaming the victims and saying they’re not credible. After all, it’s worked out for him 37 times already!!

    Looks like this guy needs a one way ride ride to Kentucky.

    Ive never been homeless so I dont get it but I would THINK that I would prefer to go south. Its warmer there all year and I wont die in my cardboard condo during the winter. Why does Worc have so many homeless yet NH VT and Maine have nearly none?

      A little digging and it looks like Framingham is in the Mass. 5th congressional district, Rep. Katherine Clark, formerly Ed Markey until he got rewarded for his decades in the Mass. Democratic Party Machine and got kicked up to Senator.

    Couple of thoughts:

    Are these judges elected or appointed? If elected, you need to find some better candidates next time around.

    Homeless people have cell phones?

    “Pelfrey rode away from the scene before police arrived and police obtained a warrant for his arrest.” – Rode away on/in what? Just curious – was it a scooter? a segway? a BMW? a horse? The mind reels!

    “A Dangerousness Hearing” – this is a legal term? Really?

    I’ll be pondering these things all day 🙂

      They’re appointed, but in this liberal state they’d probably end up re-elected anyway. As for the cell phone, that’s her obama phone. Because having a cell phone is a right in this country.

      Dangerousness Hearing. Yes KJDS it is a real thing and it is a good thing in my opinion. Under Massachusetts General Laws, ch. 276, s. 58A (1) in part determines, “The Commonwealth may move, based on dangerousness, for an order of pretrial detention or release.” In a nut shell it’s a hearing to decide how they are officially charged with either amendments / addendums or deletions in the criminal charges made in conjunction with the D.A.’s office and the appropriate bail or no bail to be set following that inquiry.

      To be honest, I like it. Years ago they did not have this so some Judges would set a bail ridiculously low with subsequent shit hitting the fan when these people get let out onto the streets during a pretrial phase that should never have been let out. This works especially well in Domestic Violence cases. We’ve all read the shit storms that happen in those scenarios. Dude gets arrested, gets bailed with no Dangerousness Hearing, goes back to finish the job then kills wife. We learn the hard way don’t we?.
