Hey turtle riders, I wanted to give you a quick update on our legal battles. As you know, we’re being sued by 4 people right now:
- Rian Waters
- Jennifer Azadnia (and her attorney George Leontire)
- Jamie Generuex (Packleader Pet Trackers, along with 10 codefendants)
- Kathryn Narcisi
Waters is pretty much done, although he is appealing it. I don’t anticipate that one costing me any more money.
Failure Swift (Narcisi) never filed a response to our motion to dismiss, and I’m being represented by the ACLU of Rhode Island so that case is of no cost to me.
However, the other two are still going on and can be VERY expensive. I cannot find any insurance company that is willing to insure my business, so if you know of any insurance agencies that specialize in professional liability insurance please feel free to email me at email@example.com.
With the Pet Tracker’s case we have filed a motion to dismiss, which their attorney opposed. The hearing on the motion to dismiss will be in September in Woburn. So far that’s cost me $2,000. If the lawsuit isn’t dismissed then it will drag on and get more expensive.
With the Azadnia case I’ve spent $6,400 in the last month alone fighting this. The motion to oppose their request to gain access to my emails, private messages, hard drive, phone, and other accounts, cost $3,000 alone. Leontire filed an emergency motion to extend discover through October, which the court will likely allow. That’s another $1,500-$2,000. Then we’ll file a motion for summary judgement and have a hearing on that, which will be another $5-$7. So the bill is up to $15,000 to fight this frivolous, ridiculous lawsuit over a blog that was critical of a wealthy and powerful woman running a public business that had dozens of complaints made against it. And if we lose on summary judgment it will have to go to trial and that would cost $20-30,000. I have no doubt that we would prevail since we haven’t libeled anyone, but we can’t afford that, we would run out of money, they court would place a default judgement against us, we’d declare bankruptcy, forfeit our assets (the blog) and the blog would no longer exist. Then this woman would win, and would get the satisfaction of knowing that she personally brought down a blog that broke the Mass State Police scandals and hundreds of other stories the media wouldn’t touch.
I’d really hate to see that happen, because I love Turtleboy.
Long story short, we need help. We appreciate everyone who has donated, and would not be here today had turtle riders not stepped up to the plate. However, I want to create a separate account that is just for legal funds. I want to keep all the court cases updated, and have the history of each explained. I want people to be able to see how much has been donated as well. Currently when you donate to our PayPal account you have no way of seeing how much has been donated. I want transparency and clearly defined target goals for fundraising.
GoFundMe is obviously the most popular way to do this, but they take 5% which is extreme. If you have any experience with fundraising, or are familiar with websites that allow users to see how much has been donated while taking less than 5%, please send me an email.
I love running Turtleboy Sports and I want it to continue forever. I think it’s so important for our democracy to have dissenting voice like our’s that aren’t afraid to expose corruption and say the things that so many people are thinking. But being blacklisted by Google AdSense, Facebook, and Twitter has made it much harder for us so raise revenue. The company simply does not make enough money to continue to fight these kinds of frivolous lawsuits. George Leontire’s goal is to continue to run up the bill on me with bullshit discovery requests. And the way our judicial system works it allows the rich and powerful to abuse the courts like this in order to attack small businesses like mine.
