Turns Out Boston Globe, Turtlegram Were Lying By Saying “WPI Says Rape Victim Partly Responsible For Rape”

Yesterday the Turtlegram, Boston Globe, and Wacky Walter Bird all put out headlines claiming that WPI was blaming a rape victim for being raped in a WPI-leased apartment in Puerto Rico:

Alright, first things first. A very smart lawyer left this comment on the Facebook machine:

The rape victim sued WPI for negligence. It’s a classic defense to a negligence claim that the claimant was also negligent and would be successful in defeating the claim if it could be shown that the claimant was more negligent than WPI. There is NOTHING WRONG with that discussion, except that it touches the raw nerve of some that rape victims never do anything wrong themselves. Maybe WoMag could have worded the question differently, but the discussion point has legal validity.

The rape victim sued WPI for negligence. When you sue people in contentious situations like this, they have a right to defend themselves. This is STANDARD OPERATING PROCEDURE!!! The Globe, Turtlegram, and Wacky Walter had to put these headlines out because they know it’s a hot topic right now. Page views 101.

But the problem is that the headline they put out was a bold faced lie. Here’s what really happened, according to WPI’s Facebook page:

The Turtlegram, Globe, and Wacky Walter are selling you lies. The school helped convict a rapist. He alone is responsible for the rape. Now the victim is trying to get paid by the same university who helped convict the only person responsible for the rape – the rapist. She is blaming them, so now the insurance carrier is blaming her. This is how court works in grownup world. When a rape victim takes the stand and accuses someone of rape they get cross examined by the defendant’s attorney. Often this attorney blames the victim too. It’s not pretty, but once again, this is how court works in grownup world.

The bottom line is this is a lie:

Because WPI does NOT allege that the victim is “partly responsible for the assault.” The insurance carrier that the school is no longer affiliated with is alleging that in court, not the school. But the headline says the SCHOOL is making these claims. That is a bold faced, defamatory lie from two filthy, dying newspapers, and we hope both newspapers get sued. This is why people come to Turtleboy. Because you can’t trust the mainstream media.

    Graduate of WPI in 2005 and again in 2012. Participated in this program of studying abroad. The school does EVERY thing in their power, including treating students as if they are children, to prevent things like this from happening. The training material borders on insulting. That ADULTS, who have not only gained entry into one of the better engineering colleges in the country, but then within that institution gained entry into a prestigious project assignments (you don’t just GET to do work at foreign sites, you have to apply) should have to be taught these things is mind boggling. Other than assigning a private body guard to each student, I’m not sure what else the school could have done to prevent this.

    How fuck can this woman even point blame to the school in the first place? She wasn ‘t on school property. Ok, I feel for her because she experienced a traumatic event. But the rapist was caught and punished because he perpetuated the crime, not the school.

    This woman is now graduated, as mentioned by the school, and is probably not able to find work (Yes, that is an assumption on my part) and is in dire need of cash. Boom…get lawyer and now blame the school and try to get a payout. In order to get a payout she has to claim the school was at fault. She opened Pandora’s Box here, not the school and not the insurance company.

    I agree with the insurer. If she can claim that WPI is at fault for something that happened off campus, then she too can be at fault for putting herself in that location off campus. Turn around is fair play here. If this hurts people’s feelings, well too bad, this is reality.

    I hate when people act out of greed. If she really was acting on behalf of being scarred or hurt, she would be going after the rapist. But alas, he has nothing so its not worth it.

      I believe that WPI leased the apartment building in Puerto Rico specifically for student use. They employed a security guard for the building, and the security guard is the person who committed the rape.

      So, while this is technically ‘off-campus’, the school was responsible for the lease and the hiring of someone who was a risk to their student body.

      Whether that argument actually holds water is another question, but that’s how they can be named in the suit.

        Hey, you know what? The LEAST that could be the outcome of this, is that the school will be forced to be more careful hiring its employees. And that’s a good thing.

        They didn’t hire the security guard. The housing company did. WPI did not have anything in their lease agreement for the provision of security. The housing facility is at fault there. Also WPI (Or any college) can NOT vet every person a student comes in contact with abroad or at home but they can take steps to keep kids safe, which they do in the form of Education Classes, Chaperones, and Help Lines. These “kids” are adults. They should act like it.
