It’s not an uncommon start to a story here. Turtleboy is facing yet another frivolous lawsuit. These lawsuits tie up our court system and are simply used as a mechanism to try to silence free speech. They force us to hire lawyers, who aren’t cheap, in order to get these ridiculous complaints dismissed. We’ve never lost in court, but judges do not grant lawyer’s fees when you win. When you see the lawsuit we’re dealing with right now you will see the pure evil we are up against. The lawsuit this time is for publishing a blog two years ago detailing the very public airing of a domestic incident that occurred between a Palmer man and the mother of his child, Samantha Cardin. The blog did not take a hard stance as to the guilt or innocence of either party, but rather provided satirical commentary on a highly viewed Facebook post.

As you can see from Rian’s tone, he is very sure of himself and exhibits arrogance that the people running the Ludlow jail are are “stupid.” But after reading the blog I am not sure what the blogger’s opinion is in relation to the guilt or innocence of Rian Waters.

But this story has a sickening twist. Unlike past litigation, Turtleboy Sports is not the only defendant listed in Rian Waters’ complaint. He has also named Ms. Cardin, and this is where things get highly objectionable. Here are portions of Rian’s complaint against Aidan Kearney and Samantha.

At about 5pm on December 31 2016, the Plaintiff was arrested for animal cruelty, and assault and battery. The Plaintiff was shocked to hear the charges. The officer twisted the few words the Plaintiff said, and claimed his bail was ten times the actual amount. The Plaintiff had almost enough on him to cover the correct bail.

As you can see, he is also accusing the police of lying in their report about what he said, while noting that he was doing so well financially that he had the money on him to pay for the bail, which was 10 times the amount he claims it was supposed to be.

In an amended complaint he also claims that he avoids going to his house now, thanks to a comment Uncle Turtleboy made on a Facebook Live show.

Rian Waters does not have a lawyer and is representing himself pro se. He has started a GoFundMe that has raised over $300, which claims that his lawsuit will “likely bring an end to Turtleboy Sports.” That is his goal. According to the GFM the money he raises will go towards food and transportation first, and any additional funding will go towards his legal expenses.

It should be noted that Michael T. Gaffney, who also filed a frivolous fraud and libel lawsuit against Turtleboy and Aidan Kearney, has written an affidavit for Rian Waters, showing that the two of them are clearly working together to silence a blog that has criticized them both.

Essentially Gaffney has become the real life incarnation of Attorney Richard N. Vulva by assisting random people who threaten to sue the blog.

Suing Aidan Kearney and Turtleboy is one thing. Suing a woman who alleged domestic violence is despicable and is a tactic abusers use to continue to harm their victims.

Sam’s story isn’t all that uncommon in its own vein, either. Statistics say that 1 in 4 women, and 1 in 7 men will find themselves victims of domestic violence in their lifetime. The numbers are staggering, the reality harrowing. Sam’s reality was no different than the rest.

“We met when I was 18, one day when he came to my then boyfriend’s house,” she recalls. “He was selling Grateful Dead tee shirts. I bought one. I thought he was cool; he went to festivals and traveled a lot, and said he was trying to start his own business. He seemed smart.” The relationship progressed quickly, with Rian playing the part of a smitten suitor. “He was sweet, and attentive, where the guy I was seeing was a heavy drinking loser. Rian swooned over me. He practically moved into my house before we had even started dating.”

And within 4 months of the relationship, he had convinced her to go out west with him to California.

“That was the start of him showing signs of becoming abusive,” she says, “Or at least the ones I fully realized. It would have probably been a lot easier to leave the relationship, had I not left with him and flown 3,000 miles away from anyone who cared about me.”

But it was all a lie, time and time again, Rian’s business ventures failed, often so quickly that not even one annual report would be filed before the inevitable suspension, dissolution or abandonment took hold. Sam discovered his true industry, making and selling THC concentrates, a crime that carried as stiff a penalty as meth manufacturing, due to the chemical process entailed.

“He would threaten to blame it all on me,” she told me, “I knew it wasn’t legal, I didn’t want anything to jeopardize our daughter. I had no control over anything in my life, I didn’t know what to do.”

She shows me picture of her bruised and battered, allegedly by his hand.

“I went homeless trying to get away with my daughter. We slept in tents on farms, I worked 16 hours a day, just to make enough to get home to Massachusetts.”

Then in December 2016, things came to a head when Rian returned to Massachusetts from California where he still resided, to visit for the holidays. This visit would result in Sam sustaining a black eye, her 10 month old, 79 pound Great Pyrenees/mastiff’s having an untimely and suspicious death, and culminated in Rian’s arrest for domestic violence and animal cruelty.

But for Sam, it didn’t end there.

“I would see vehicles parked outside my house, lights off, with someone sitting inside. I felt it was him, but I just never could get enough proof.”

Meanwhile, Rian would send message after message, attempting to coerce, threaten and bargain with Sam to prevent her from testifying in court.

  

It worked, and Samantha refused to corporate with the District Attorney in the case against Rian. Charges were dropped, without prejudice. Ms. Cardin is not a woman of means, and was scared into believing that if she testified against him that she risked losing custody of her special needs daughter, because she claims that Rian Waters would’ve accused her of having drugs in her house that he sent in the mail from California before arriving.

However, having the charges dropped is not an exoneration; it’s simply the gears of justice grinding to a halt as they so often do in cases such as this. In the matter of an assault that so often occurs with no witnesses, victim testimony is imperative. Batterers know this, batterers capitalize on this. An official source close to the criminal case has assured us the injuries to the dog were non-accidental, and that Luna was killed, but without a cooperative witness, prosecution often falls flat.  So Rian was free to continue his campaign to harass, discredit, and frighten his ex, as he had done so many times before.

And Rian wasn’t finished yet. As he attempted frantically to reestablish contact with the woman whom he was arrested and charged with abusing and got nothing but silence in return, he soon turned his attention to Turtleboy Sports. In May he started emailing Uncle Turtleboy, taunting him about filing a lawsuit.

But before filing the lawsuit he offered NOT to go through with it, if we retracted the blog about him, paid him a “small cash settlement,” and to do a follow up article which would presumably speak his praises. According to the email Turtleboy would “lose credibility when the facts go public,” because we “attacked an innocent and good man,” even though he was never found not guilty. He claimed that he couldn’t get into the Open Society Foundations because of the blog, and that he was going to travel to Worcester to “meet” with Uncle Turtleboy.

Still no lawsuit was filed, and he continued to taunt about the possibility of a lawsuit in the near future. As usual he was a genius who knew how to quadruple our audience, if only we sought his advice.

After filing the lawsuit, which amongst other things claims libel because it referred to his mustache as a “collection of dirt and pubes,” he attempted to extort money from us by promising to withdraw for cash. Specifically he wanted $1,500, plus a $5,000 advertising credit. He also wanted us to write a two part blog (which he would approve of before publishing) that smeared his daughter’s doctor, smeared Samantha, and painted him as a loving father fighting hard to regain custody of his daughter (who he admittedly does not pay child support for).

“Sadly I can’t drop the suit completely because Samantha is still crazy and this case is slowly bringing her back into reality“, he writes. “But I can have a lawyer draft a proper settlement agreement and drop all defendants but her.” 

We will not be threatened or coerced into the continued abuse or harassment of a young mother, and we will not be silenced. A dog is dead, a young mother battered, all in the presence of her young, disabled child. And so, this blog is caught in the midst of litigation where the stakes are higher than we have ever seen. This transcends our right to free speech. This now involves the rights of victims of domestic violence to be free of further harassment and coercion, all but sanctioned by our legal system. It is patently absurd that a judge is even hearing this case, but it’s just how our courts work.

Samantha is being sued for “malicious prosecution”, among other baseless complaints, for a criminal case brought by the Commonwealth, not by her.  Turtleboy is being sued under the guise of a blog that simply offered commentary on a situation made public via social media. Commentary which, quite frankly, seems far too forgiving.

This tactic of using the legal system to further perpetuate abuse on a victim that Rian seems to gleefully employ is not unusual. In a system that allows for nearly any complaint to be filed, no matter how frivolous, it becomes easy for abusers to drain the financial and emotional resources of their victims, leveling continued harassment and intimidation, and all through the perfectly legal channels of the courts. For so many victims, with scarce resources and battered confidence, the results can be devastating – regardless of the actual merits, or lack thereof, of the case. Such is the case for Sam. Without a firm grasp of the legal system, and no access to an attorney, a default judgement has been filed against her. She has a hearing on Wednesday, January 9 that Rian wants recorded.

“He served a previous address, I didn’t even know where to go, or when,” she tells me, “I didn’t think he’d be able to take it this far.”

But he did.

I’m generally not in the habit of asking our readers for donations, but this to me is a glaring exception. What this man is doing is pure evil, and he has the ability to do some serious financial damage to the company by draining us of our limited time and resources, after already being under attack by boycotters, threats, and tech companies.

We can’t just roll over and let this man inflict this damage onto the woman he so egregiously mistreated for so many years. We cannot stand by and let yet another abuser use the courts systems to further his own agenda. If we exist for anything, it is to expose these issues and stand for those who cannot stand for themselves. As little as a $5 donation will help us fund this fight. If you can’t donate, please share.     TB just shows up to court and hands out pictures of Rian to the judge and jury and says ‘yes we wrote his upper lip looks like a combination of pubes and dirt here is our evidence to the fact!’. The court will laugh at the pic and say yes we all agree that’s pubes and dirt on his lip. Case closed.

    Mr. Rian a self described “serial entrepreneur” and music festival creator is arguably a public figure based on his own “business” ventures. Further Mr. Rian’s arrest for alleged crimes and public record of said arrest most certainly makes Mr. Rian a public figure,.

    Assuming success as newcomer to the entertainment industry is an atrocious assumption. The greatest directors, screen writers, performers and technical experts in the world reside in the Hollywood movie industry. Yet even the very best with the very best financial backing and predictive analytics routinely spend hundred of millions of dollars on a sure-thing only meet fantastic failure. (Welcome To Marwen Universal Studios 2018) $39 million budget, worldwide box office $8 million, deficit $31 million dollars.

    Mr. Rian intends to prove his music festival failed due to TBS, laughable. Mr. Rian further objects to his facial hair referenced as pubes and dirt, slang for poor facial hair. Poll a cross section of the public some will like his facial hair some will agree with TBS and most won’t care. This is a matter of taste and opinion and not arguable in a court room.

    Mr. Rian was arrested by the police for committing alleged crimes, this is a factual matter and reported by the police, reporting on the matter is public record and can not be disputed as malicious. Mr. Rian’s complaint that he was not a resident of Palmer, Ma. again is without merit when the information came from a public police report.

    1) TBS views this nuisance case as pointless but potentially costly.

    2) TB isn’t as sharp as I believe he is and afraid of this absurd case.

    3) TB and TBS like any good media is happy to use this pathetic law-suit bring a little excitement into their blog and at the same time expose the foolish legal threats that are common place in our society.

    I’m betting on #3.

    New York Times, Globe, Washington Post et al. front page accusations and one paragraph page 12 corrections is a daily business practice. Even the accusations written in the suit are making huge assumptions and using faulty logic. Too many “IF” statements that didn’t use “if” in the suit. A 9th grade English teacher would grade this as (re write and submit again, or take an F).

    My general rule in life is “trust no one”. That has helped me avoid lots of problems. Of course, I’m not a lower-class female looking for love in all the wrong places. There are millions of guys out there just like Rian, but over-trusting females still fall for them.
    As for people objecting to Turtle Boy’s advertisements, I don’t see a lot of ads when I open the pages. Am I getting special treatment?

    Title 18, U.S.C., Sec. 1512, makes it a Federal crime or offense for anyone to use intimidation or physical force to threaten another person with intent to influence the testimony of a witness in any Court proceeding.

    A person can be found guilty of that offense only if all of the following facts are proved beyond a reasonable doubt: First: That the witness was scheduled to be a witness in court; Second: That the person used intimidation/physical force against such witness; and Third: That the person did so knowingly and willfully with the intent to influence the testimony of the witness.

    To act with intent to “influence” the testimony of a witness means to act for the purpose of getting the witness to change or color or shade his or her testimony in some way; but it is not necessary to prove that the witness’ testimony was, in fact, changed in any way.

    His post from Jan 2 is witness tampering. He tells her he’ll do someone if she does something. His vow to ascend is a form of intimidation.

Has professional licenses that can be held up for renewal? Cares if he drives with out a license? Would even be punished for driving without said license?       “Legit news” like NBC doesn’t have their advertisers subject to harassment campaigns that force them to leave. They don’t get blacklisted by Google Adsense, Facebook or twitter. If these things didn’t happen to us we’d have plenty of money to fight this on our own.       I know from personal experience that winning that kind of thing amounts to nothing more than words on paper. These kinds of judgments are only ever enforced against the good guys. The system is set up to favor the bad guys in every possible scenario. The less you have to lose the more damage you’re able to inflict. This was an extremely expensive lesson for me as I was the one with the money to lose. While the dirtbag did eventually go to prison I’ll never see a dime of the tens of thousands of dollars that I spent responding to and defending against bogus accusations.

    This kid is 100%  dirt and pubes.       
    I grew up with a “father “ just like this. 
    He thinks he’s the smartest person in the room.  It makes me sick to my stomach how he acts like he’s giving this mom any time with their child.  How  he thinks by offering meds his baby NEEDS only if she talks to him. Why does he hold her meds hostage?  So many things he wrote is screaming narcissistic asshole.

    Dear Turtleboy. (yes, I realize Bristol wrote this) I wanted to ask you a question, I tried to write this comment and question prior to this, but it was deleted for some reason? Please know that I love your news blog. I have nothing against you. You have never written about myself or my friends, I do NOT agree with the man/boy above for any reason if he hurt this woman and child. This question is not out of spite, but genuine curiosity. You are asking for donations as you state that the above lawsuit could “bankrupt” you and your business. How is this any different than a go fund me? You say people that have go fund mes are scum of the earth. Yet you just sold a home in Worcester for $150,000 and while that was in the process, bought another home for half a million dollars in Holden. Why is it that when you go to court for these “frivolous” lawsuits, you always state YOU are not the one that writes these blogs? In essence, you are blaming the very people that work for you and using them as a scapegoat. How is you asking for money from others on this blog, any different than others with go fund me accounts? You own a home that is worth a HALF A MILLION DOLLARS! Just how much do your writers earn pray tell? Yet again, i’m asking you a serious question in hopes that you answer this time instead of deleting my comment. I have nothing against you, and I have nothing to gain from this question (in hopes you will answer) I’m not anyone you have ever written about, nor do I know anyone that you and your bloggers have written about. This is a serious question and I just want to know what your answer to it is? Again, how is you asking for donations so you don’t go “bankrupt” while you are living in a half a million dollar home, any different than anyone else that has a go fund me and looking for money?

      I don’t normally read the comments, so feel free to email in the future. But here goes.

      This isn’t a GoFundMe, and there are many good GoFundMe’s. We call out frivolous GFMs, like 21st birthday parties to Foxwoods. This is giving people the option to donate to a cause they believe in. It’s quite common among conservative publishers today, such as Dave Rubin and the Daily Wire. The left controls social media and often get demonetized, so people who express conservative opinions are forced to turn to their readers in order to keep the blog alive. Without donations we will stop existing. Free speech is hardly free. We do not have the ability to print money, and we’ve lost well over $100,000 in revenue in 2018 as a result of various forms of censorship full explained in the book.

      My home is not worth half a million dollars. The shithole house in Worcester that I bought in 2009 and sold in 2016 was purchased when I was single and a teacher. Then I got married. When you get married your combined earning power doubles, and thus you are able to purchase a home that costs more money. We lived below our means for many years, saved, and waited for the time when the market was right to purchase a stable home for our family. This is what responsible adults do with their finances, and I fail to see what any of this has to do with GoFundMe. We’re not asking for money for a house.

      Not sure why you use quotes on “frivolous” since these lawsuits are the definition of frivolous. For the blogs we’ve been sued for I have not been the one to publish them, but as the legal owner of the blog I take full legal responsibility. Seeing as I’m the one that actually has to go to court and pay for the lawyer, the fact that you would call this “blaming the very people that work for you,” is so absurd that I’m sure you understand why it requires no explanation.

      Because we provide a service that people are willing to donate to in order for that service to continue. Much like how people pay for newspaper subscriptions. People begging for money on GFM provide nothing in return for the investment.

      No I don’t. We bought the home for $395K. It’s public records. And it’s really not that much money. Anyone on two teachers salaries could qualify for a $500K loan.

      This is answered in the book, but they receive a commission based on the ad revenue they generate from page views on blogs they publish. We believe in merit based pay, which is why Bristol and SSTG make more money than anyone. Eventually I’d like to be in a position where I can offer them a full time salary, but we’ve taken quite the hit in the last year so that’s just not possible.

      No one deletes your comments. I hardly have time to read all the blogs published on this site, never mind the comments. You’re not that important that I’d waste time censoring you.

      Because I’m not asking you to pay my mortgage. This money goes directly to legal fees so the blog can continue to exist. You like the blog right? Well this shit costs money to keep going. If you’ve never donated or purchased something before, that’s fine. No one is required to. If people feel like Turtleboy is something they can live without then the free market will spell our demise. But as it is we stay afloat because we have such loyal fans who really understand the effects that censorship has on free speech forums like ours.

        Hello Uncle,

        Have you considered setting up a separate TBS Legal Defense Fund? That would help with transparency and allow people to segregate their donations. It could alleviate some of these concerns. LDF’s are quite common, particularly for individuals being persecuted by the state or big money interests.

      Regarding GoFundMe (GFM) the writer of this comment doesn’t get what Turtleboy Sports (TBS) is about, and/or lacks reading comprehension.

      Very rarely, if ever, does TBS slam a GFM and not mention that there are so many causes on GFM that are actually deserving of a donation. To compare this blog and the countless GFM blogs TBS has featured is way off.

    I don’t see how this isn’t criminal. My sister went through the same thing and the guy went after everyone around her like me and my mother. Ultimately he got put in prison for impersonating her and making threats but he cost us a shitload in legal fees. He would make up bogus cases one after another and file them in different courts. It was crazy

    Scary to think a total moron like Ri Ri can inflict this kinda damage. When the suit is inevitably is dismissed, that prick and Gaffney should have to pay your legal fees. TB you were too honest when you blogged about the end of gaffneys suit. He obviously read it and realized the problems his litigation was causing you. Shhhhhhh. Loose lips. So sick of these people trying to silence anyone who they disagree with. Must have pretty empty lives if tying up the courts suing TB is what gets you going. Loooooosers
