Turns Out Former Lawyer For ABCC, Which Is Shutting Down Nashoba Winery, Is President Of Beer Distributors Of Mass

So in a huge victory for the Nashoba Valley Winery, Governor Charlie Baker yesterday announced that he is backing the winery in their ongoing battle for survival with the ABCC:

Baker told the News Service that he did not support the recent decision by the Alcoholic Beverages Control Commission to inform Rich Pelletier that after 16 years of operation he had to choose between his farmer’s manufacturing license or his pouring license for the on-site restaurant where he also sells his wines and beers.

“I don’t understand why after 16 years this decision was made and I think it’s one where if there’s a legal question we should solve it by challenging the legislation and if it’s an administrative issue we should solve it through a legal process, but one way or another I think this sends a bad message to small business and a bad message to farmers, both of whom I care a lot about,” Baker said in an interview in his office.

This is what we do at Turtleboy Sports. We blow up politicians and make the do the right thing. This is why Charlie Baker was elected. Because Martha Coakley NEVER would’ve had the minerals to cross the ABCC and her corrupt friend Deb Goldberg, the State Treasurer who runs the ABCC.

Anyway, you gotta wonder who blew the whistle on the Nashoba Valley Winery. They’ve had two licenses for 16 straight years and it was never a problem. Someone snitched and made a federal case out of this, but who was it? Well it just so happens that a former big shit at the ABCC named William Kelley is now the President of the Beer Distributors of Massachusetts.

Ya got that? A guy who used to work for the regulatory agency that has arbitrarily decided to destroy a local winery is now the President of an organization that loses business to local wineries like Nashoba Valley. Do we have any proof that he is responsible for this? Nope. But common sense should tell you that it’s problematic if the same guy who used to work for the ABCC now is the president of the organization that seems to benefit most from the ABCC’s sudden desire to enforce random rules that it has never enforced before. Just sayin.

When he was working at the ABCC in 2011 they also tried to shut down local brewers, wineries, and farms:

The Massachusetts Alcoholic Beverages Control Commission issued an advisory yesterday that has some brewers scratching their heads — and probably worrying about their futures. The ruling apparently will make it more difficult for small beer makers to get licensed. Many of the state’s breweries have what are known as farmer-brewery licenses, which are less expensive and less cumbersome to obtain than full manufacturer license. The licenses also allow breweries to distribute their own beer locally, sell beer on premises, and operate tasting rooms.

The ABCC’s advisory — which followed its decision last week to deny an application for a farmer-brewery license from a new beer maker called Idle Hands Craft Ales — says a business can get a farmer-brewery license only if at least 50 percent of its beer-making ingredients are grown in Massachusetts. That would pretty much disqualify every brewery in the state.

Then later in 2011 William Kelley caused a stir at the ABCC when he went after Groupon. Ya see, Groupon lets people purchase a $40 gift certificate to a restaurant for $20. But if you buy any booze using Groupon you are violating the law he chooses to enforce:

Kelley points to the Prohibited Practices section of Massachusetts General Laws as justification for why deals like this are prohibited. Also known as the Happy Hour Laws, they forbid  selling, offering to sell or delivering to any person or group of persons any drinks at a price less than the price regularly charged for such drinks during the same calendar week.

Shutting down small businesses and making sure no one ever has fun seems to be the major goal of the government in Massachusetts. So much for standing up for the little guy.

William Kelley was also, the “ABCC’s liaison to both Massachusetts Attorney General and to the State.” And wouldn’t ya know it? The Attorney General (albeit a different AG) is backing up the ABCC’s decision to shut down the Nashoba Valley Winery.

See how it’s all connected here? Big shot lawyer gets job working for ABCC and tries to shut down local brewers. Then he takes a gig as the President of the group he was basically lobbying on behalf of before. Now all of a sudden a vague rule that would destroy the same businesses he tried killing five years ago is being enforced. Oh yea, and state beer distributors just so happened to contribute a buttload of money to Deb Goldberg’s campaign for State Treasurer, and now she controls the ABCC.

Here’s the best part. Now that Maura Healey’s office has been exposed, she all of a sudden thinks the Nashoba Valley Winery is a good thing:

A Healey spokeswoman called the Nashoba Valley Winery a “vibrant community anchor that reflects the state’s commitment to local food and agriculture.”

Gee whiz Maura, how come you weren’t saying that a couple weeks ago? As a matter of fact when Rich Pelletier (the owner of Nashoba Winery) brought this to your attention and was forced to bring this to court, you tried to dismiss his claim:

In Suffolk Superior Court last week, Pelletier sought to restrain the ABCC from withholding the renewal of his current licenses. The office of Attorney General Maura Healey, which defends state agencies and commissions, moved to dismiss Pelletier’s complaint.

But just like Jamie Eldridge and the rest of those State Senators who switched their vote from “no” to “yes” for $300,000 worth of bullet proof vests for cops after we exposed them, Maura Healey is dancing a new dance now that the spotlight is on her. Funny how that works. Welcome to Massachusetts, where corruption like this is the way of life. The only difference is that now they have someone watching over them and exposing their tricks.     Obviously the right people werent brided or else this business owner would have no issue at all. And yet everyone wonders why people are sick and tired of the status quo. We no longer need politicians in office. What we need are public servants who actually serve the public and not whoever fills their pockets with the most cash.

    No surprise again, most people know how the state is run. This is another example of many abuses and conflict of interests. Compared to the old days, things as a rule are done in a quieter and more sophisticated way now. But, at times they’re still uncovered because of their arrogance and raw stupidity. Some things never change, money is the bottom line !

    Good for you TB. Most people get all up in arms, make a few hollow fb comments and forget about stories like this as soon as the next one comes out. Admirable that you stick with these stories, people and businesses and evoke actual change. Also, fuck these dishonest douchebag politicians, they are no better than any other criminal. Good for Charlie Baker too.
