Judge Blocks ICE From Making Arrests At Massachusetts Courthouses, Making MA a De Facto Sanctuary State

Immigration and illegal aliens (or undocumented immigrants depending on your political leanings) are certainly hot button political topics right now. It seems as though the subject is unavoidable in the media, on Facebook, and even water cooler talk at the office. Everyone has an opinion on it. President Trump and his supporters want to build a border wall. His political opponents want sanctuary cities and better treatment of those who cross the border illegally. With this ever present ideological struggle, I wasn’t even remotely surprised to read this headline from CNN yesterday:

“Massachusetts federal judge blocks ICE from making civil immigration arrests inside state’s courthouses”

“A federal judge in Massachusetts on Thursday blocked federal authorities from making civil immigration arrests inside the state’s courthouses.

US District Judge Indira Talwani issued a preliminary injunction that blocks US Immigration and Customs Enforcement and the Department of Homeland Security “from civilly arresting parties, witnesses, and others attending Massachusetts courthouses on official business while they are going to, attending, or leaving the courthouse,” according to the court order.”

 

 

I don’t even know where to begin…

I am the son of immigrants. My parents came to this country to build a better life for themselves and future generations of our family. They went through the legal process to do so, which, admittedly, was much different in the mid-60s. I am in no way anti-immigration. I am, however, all about law and order and the rules applying equally to everybody. I’m not advocating for ICE raids that lock up housekeepers and landscapers, but deporting CRIMINALS who came here illegally and then broke the law again seems like a no-brainer, right?

“The order follows a lawsuit from Middlesex County District Attorney Marian Ryan and Suffolk County District Attorney Rachael Rollins…”

A lawsuit to prevent law enforcement from doing their job, filed by two people who were elected by the people of Massachusetts to enforce the law. Unbelievable.

You’ll recall that a campaign promise made by Rollins was a list of crimes that she would decline to prosecute if elected, including larceny under $250, shoplifting, threats, and breaking and entering. After her inauguration she softened her stance a bit, according to The Boston Herald, but then reaffirmed her position on the matter in April, as reported by Mass Live.

“It also comes after a Massachusetts judge and a former court officer were accused in April of helping a twice-deported undocumented defendant elude immigration authorities by slipping out a rear courthouse door.”

“At the time, Massachusetts Attorney General Maura Healey said the indictment was “a radical and politically motivated attack on our state and the independence of our courts.””

Maura Healey calling anyone else’s actions “radical and politically motivated” is laughable.

We have a state full of activist DAs and judges, whose actions and decisions have led directly to the deaths of police officers and civilians alike, yet our Attorney General feels that a judge and DA who conspired to help a criminal escape lawful deportation shouldn’t have been indicted. Makes sense.

I know the narrative is that cops are bad, so maybe you don’t feel sympathy for Michael Chesna, Ron Tarentino, or Sean Gannon or their families. Instead, you should consider the lives of Richard Field and Lina Bolanos, two doctors who were murdered in their South Boston condo by Bampumim Teixeira, a West African immigrant who, upon his second conviction for armed robbery of the same bank, was given a 364 day prison sentence to avoid mandatory deportation.

This order from Judge Talwani once again shows what Turtleboy has been saying for a while. Judges in Massachusetts are out of control and care more about the feelings of criminals and people who don’t belong in this country, than they do about hard-working taxpayers. Judges serve for life, but the people who appointed them do not. The only way to change things is to stop voting in the same corrupt politicians over and over again.

    Glad to see everyone getting along and finding decent, passionately discussable points.

    “Y” is in fine form as per usual, this “z” guy flys in with textbook knowledge tryin’ to impress, let’s not leave out those people debating the possibly misconstrued judge & attorney title/positions.

    The real takeaway from this:

    A group of people helped to make a law with many complex ramifications covering all aspects of living in the land of the free and home of the brave, a little more compassionate to the human condition.

    What not to focus on:
    Detractors who would like to over simplify and implement the strictest letter of the law to a complex crime.

    David Ramos Contreras, Mexican illegals, and two others allegedly gang raped two teenage girls, 12 and 13;

    Juan Leon Gomez, a Guatemalan illegal arrested last week on allegation of rape and impregnating an 11 year old girl;

    Manuel Amador, a Honduran illegal, arrested for allegation of rape and kidnapping a 74 year old woman. Amador allegedly abducted her off the street dragged her into his garage and allowed his roommates pit bull to bite the victim on the legs and feet. He held her captive for 4 hours at one point she was choked and passed out;

    Chrithian Bahena Rivera allegedly murdering the Iowa college student mollie Tibbits. She caught his eye because she was jogging on a public way. Ultimately, the autopsy will possibly reveal she was tortured before death. He was in this country for possibly 4 to 7 years before his alleged act against tibbits.

      Ultimately, a wall would be ineffective. You can climb over a wall. You can tunnel under a wall. You can fly over a wall. I’d much rather see then spend that money on immigration reform and hiring more Border Patrol, ICE, and Homeland security personnel.

        Good luck climbing over a 30 foot wall, and the wall is outfitted with earthquake sensing technology to alert border agents to tunneling.
        But, yeah, we should just leave the border wide-open and let them come and go as they please; it’s working out spectacularly, isn’t it?
        At least w/the border wall, they can then (once completed) start to allocate money and resources to other issues (better policy, more agents, etc.).
        The wall is just the start to securing the border.
        I don’t understand what is so hard to figure out.

      Well, the Mass. SJC ruled last year in the criminal Comm. v. Linn case that because there’s no immigration laws on the books in MA, the State Police can’t assist ICE. This ruling by the Federal Judge is nothing new since Trump took office. We’ve actually been a sanctuary state for over a year. The more illegals, the less of a future legals have.

      I’m sorry that nuance is lost on you. Two MASSACHUSETTS district attorneys filed a lawsuit in federal court seeking an injunction. A FEDERAL judge in Massachusetts issued the injunction that applies to Massachusetts courthouses. The other judges and district attorney written about in this blog are from Massachusetts. What part is inaccurate, exactly?

    It may be more than just Mass. It’s a federal judge. Aren’t rulings usually binding in that federal circuit until appealed upstream?

    This may be in effect in MA, RI, NH and ME. Possibly PR.

      According to the CNN article, the ruling was specific to Massachusetts courthouses in response to a lawsuit filed by two Massachusetts district attorneys. I read it to mean it would specifically apply to Massachusetts, though other states in the district may be affected if they file suits as well.
