Okay, now that the arraignments have concluded, the question stands: Will Rachael Rollins tell the Assistant District Attorney handling the case to take a dive? In other words, if the ADA handling the case doesn’t file certain paperwork or comply with the Criminal Rules of Procedure, the Defense can move to dismiss the case. For example: the best is (1) the cop doesn’t come to court. The cop would be the complaining witness since it was a disorderly conduct charge or disturbing the peace charge.
The other way is the ADA tanks the trial, by failing to question the police officer correctly or properly put evidence into trial. Think about it: is the Defense Attorney going to stand up and say “Judge the prosecution is helping my client, please make him stop!” or is the judge going to push the ADA and say, ” you are missing key pieces of evidence, we are going to stop, you will bring that evidence tomorrow and we will resume where we left off?”
That has happened, let me think: NEVER.
Remember, anyone can bring a complaint before the bar as a public citizen when it involves a public official. Question is: will you be able to see it, when it happens?
