So in one of the biggest boners you will ever hear, the wrong family in Vernon Hill had their apartment raided by the SWAT team Tuesday night. The cops were looking for some guy named Shane B. Jackson and had attained a no-knock warrant.

Here’s what happened.

At about 5:30 AM Marianne Diaz woke up buck-naked to the sound of somebody knocking down her door. The SWAT team then rammed down the door and entered the apartment, assuming the people inside were harboring Shane B. Jackson, who they believed to be armed. According to Ms. Diaz they refused to let her put clothes on and yelled and swore at her because her kids (age 7 and 5) were crying.

The problem is that Shane Jackson USED to live there. As a matter of fact that family has no idea who Shane Jackson is nor have they ever had any contact with him. Ms. Diaz lives in the Hillside Street third floor apartment with her fiancé and a friend of theirs named Joshua Matos.

Mr. Matos was sleeping on the couch. According to him when the cops entered he dropped down to the floor and while they were apprehending him he told them his wrist was injured, to which they replied, “shut the fuck up.” His wrist was fractured.

Meanwhile Ms. Diaz’s fiancé was getting ready to go to work and was in the bathroom. The cops busted down that door as well. When he asked what the fuck was going on they also told him to shut the fuck up.

Meanwhile Ms. Diaz’s room was thoroughly searched as was her naked body. Soon after this they realized the person they were looking for wasn’t there.

The cops were acting on a warrant issued in Central District Court to the Massachusetts State Police. From what we’ve read, we’re not even sure if the SWAT team members were state cops or Worcester cops.

military-police-terrorism-boston-marathon

Here’s the real capper – Mr. Jackson was arrested two weeks ago, and his registered address was on Sylvan Street. Absolutely nowhere near Hillside Street.

So what the hell went wrong? Well a state police officer had obtained the warrant based solely on a tip from a “confidential informant” who told him that Mr. Jackson was staying there and had at least two guns. The 17 Hillside Street apartment was raided previously in September of 2014 when Mr. Jackson actually lived there.

Here’s one of the many parts I don’t get – the state trooper who obtained the warrant did some background search on this. He knew that Mr. Jackson was not listed as a renter of that apartment anymore. He also knew that the electricity was in Ms. Diaz’s name and that she had no criminal record. Most importantly, he had no reason to believe that Ms. Diaz had any relationship whatsoever to Mr. Jackson.

To make matters worse they haven’t gotten an apology and District Attorney Joe Early isn’t begging them for forgiveness. Which he obviously should be. He’s actually trying to justify it by arguing that their snitch was reliable. But obviously he or she isn’t.

Look, just admit you fucked up. There’s absolutely no excuse for this none. I don’t know Ms. Diaz or anyone else who lives with her, but I know that she’s an American citizen and that comes with a shitload of really good rights. Like the fourth amendment, which protects us from illegal search and seizure.

Screen Shot 2015-08-22 at 3.37.01 PM

She also has the second amendment, which like it or not gives her the right to bear arms? What if she was a legal gun owner? She would’ve been well within her rights to shoot armed men entering her apartment. She obviously would’ve been killed, as could’ve a police officer and her children. Imagine that? I am not a police officer so I’m not gonna pretend to know how they do business, but all I gotta say is – under no circumstances can such a dangerous situation ever be created based the word of a single informant.

My mind is blown that the state police allowed this to happen. As you know, TBS is a pro-police blog. But at the same team we call it like we see it. And what we see here is one of the biggest and most inexcusable fuckups of all time. The people living in this apartment are by all accounts decent people. The mere fact that one guy was awake and getting ready to go to work tells you all you need to know. They jammed five people into a stuffy third floor apartment likely because it’s all they can afford.

And what do they get for keeping their noses clean and going about their business? They get violated. I don’t blame the cops who were involved in the SWAT raid though. They are paid to do a very dangerous job, and were told in no uncertain terms that the apartment they were raiding contained a dangerous man who would have no problem killing any of them. If they’re looking for the bad guys, I have ZERO problem with them telling scumbags to shut the fuck up. They have to assume that a warrant would be based on actual facts.

This wouldn’t happen on the West Side. As a matter of fact, I have a hard time believing the state trooper involved would even believe an informant that told him a dangerous gangbanger was living on Moreland Street.

The “confidential informant” should no longer be confidential. How do we know it wasn’t some dickweed ex-boyfriend trying to get back at Ms. Diaz? Fuck that. If you give faulty intelligence to the cops and it turns out to be untrue you don’t get to retain your confidentiality. As a matter of fact you should get your ass beat and go to jail too.

Because obviously this family went right to the sugar daddy for police brutality – Hector Pineiro – and he is gonna have a fucking FIELD DAY with this one. Normally this guy is a real buttnut who represents lifelong criminals like Gerald Jones, but this time he’s actually got a legitimate case. And none of this would’ve happened if the state police didn’t trust shitty intelligence from a shitty informant.

Yes its too bad they got the wrong intel, and a decent( alleged) family was involved. But guess what, with all the shootings, I’m happy to hear they are doing no knock SWAT raids. Do more, and more, until the right parties are caught, and all these guns are off the street. I’d rather a mistake raid, then a mistake shooting, where an innocent person was killed.

Nice write up TB. One thing I’d also mention – when (not if) this young couple and their roommate get the settlement package, it will come from the taxpayers. Police budgets won’t be affected, the judge who issued this bogus no-knock warrant won’t be affected, and the DA won’t be affected. There needs to be accountability. I also like that you correctly pointed out that the officers themselves are not calling this operation, merely performing it to the best of their abilities.

I bet the worcester cops gave the stateies the wrong address……just so the state cops look bad. WPD made it clear it was a slap in tge face to them for even asking for help! They said in the paper don’t look at us bc of this raid…look at the state cops. The f****ING cops are playing jokes on each other to get the state cops out of their biz. And then Gemme calls em in and yells at em like a citcom. What a joke.

No more union cops. It worked for them but not the people. Worcester is the 2nd largest city in new england with the 5th largest number of police. Why money. Not that we don’t have it. They just don’t want to spread the wealth. Look cops are people usualy aggitated and grumpy from sleeping behind closed bussineses who could ever blame them for not raiding the right house.

At least one poster has a problem with police, ignorance is bliss. Worcester is a shithole. Worcester Officers should get a bonus for working in it. FYI doing a raid at 6am is the safest time to do it. Thugs and gang bangers either passed out or incapacitated at that hour.

I live right across the street from this house and have met Marianne a few times, as well as her fiance, and they are a nice, young couple. Music can get loud at times, but who doesn’t blare music while cleaning or pulling up from driving? One of their daughters has a medical condition also. They are decent, hard working and don’t bother anyone. Sometimes I forget they do live here, until her fiancé pulls up from work with the radio blaring lol. This shouldn’t have happened to them. Their daughter is petrified now to go to sleep every night because she’s afraid the police are going to break in again and afraid that bad men are going to break in and hide in her room. While I support our city’s finest in blue, sometimes I have to wonder…how stupid can you be? It’s not hard to Google search someone and also keep an eye on a house to collaborate a alleged tip that someone may or may not live or visit somewhere. It’s scary…

Wait, the guy they were looking for was already in jail? HOW IS THAT NOT PART OF GETTING A WARRANT?

Rubber stamp warrants are a damn joke. Probable cause needs to be probable.

Its funny but the criminals in WORC seem to be out in the open during bussiness hours. Why did this take take place at 530am? Why did it take cavity searches ?? Cops lack of empathy do to over compensation…. Show me a job that needs no education yet you get a bonus for cake walk college courses. We pay for it. If you own property and pay taxes and pay for utilities then you pay for local an state police to work extra hours on thier asses an phones. The union doesn’t want more cops because they’re cops.

They must of worked a 16 hour detail (8 hour detail) before filling for that warrant. More cops less overtime. If being a cop is so hard and lack of sleep can make you crazy then what the fuck.

Yeah that’s pretty f’n bad. Family definitely should get some sort of compensation. And whoever screwed up need to face some punishment.

my mind is blown, that jackson was still on the streets, like so many others. The reality with the liberal Democrat judges is involvement in a minimum of three shootings before jail is a possibility.

According to the Worcester Telegram article, the family was informed that their apartment had police raids done on it in the past. While it sucks for the family to be a victim of the this goof-up by the cops, why would anyone agree on being a tenant in such a high profile place? That should have been a red flag right next to pest infestation, existing damage and bad landlords.

      August 22, 2015 at 5:49 pm

Because they didn’t want to be on the streets?

      August 22, 2015 at 11:49 pm

Actually, this building is not a high profile place….it wasn’t shitty before that moron Jackson moved in, then he came and the area turned to a shit show for a while, then the raid happened, then the landlord threw his ass out with the others living there, and then this family moved in. No issues since that moron left, no issues before that moron came….

        August 23, 2015 at 4:08 am

Given the criminal reputation of this Jackson person, I’m surprised he managed to get a decent apartment in the first place. Aren’t landlords required to screen people? I’m not trying to say that the family had it coming to them, just perplexed by this whole situation. It honestly feels like there’s a bit more to the story on what led up to this unfortunate event.

Omg….I know. Renting a place you can afford makes zero sense!! ::eye roll::
pretty sure with 5 people there and living in Vernon hill, the police kicking down the door probably wasn’t a thought of the families. I’m sure they’d live elsewhere of they could afford it.

This is horrible. The kids will be terrified for life, one is already disabled. I hope they answer for this and also learn from this. No excuse for this to happen they are trusted to protect and serve. Didn’t even apologize to the family after they realize their huge mistake.

It pains me to say this, but, I’ve been a victim of this too. I live in West Tatnuck, and 5yrs ago State Police surrounded my house, banged on my door 5am, tried to push through, to arrest my ex who was already in jail. 5yrs before that, they just walked into my house. I’m pro-cop though. They have one of the hardest jobs ever.
